I-90 denied, still have I-551 stamp, currently outside US!

Thanks for clearing that up.

yes he can enter on the i551

hes going to need a new green card sooner or later so he must apply for a new i90, hopefully with all the evidence you know he needs now

he can apply for a re-entry permit, not really needed unless he is planning on being outside the US for another long stretch of time (normally I’d just say a year but given his frequent long absences recently, I think it would be advisable if he’s planning another trip of a few months or more)

 

This is not part of your question but it does occur to me that maybe part of the reason you & your mom need to support him is you are not really letting him settle down and work properly in the US?  This is aside from the kind of travels potentially jeopardizing his LPR status and residence/presence requirements for naturalization.

He used to go to school before we came to philippines to take care our father. Then when he came back to US for 2 months he was working. The reason why my mom & I support him because he still stays with my mom because we support him financially. Recently, he visited Philippines a lot because After my dad passed last year, I cant really take care the belongings my dad left. (House, car, money) since i just recently gave birth(month ago) so i need his help. I might need him to come back here in the philippines because were not done yet taking care of our dad’s stuff.

I’m not questioning your rationale, i was simply observing the disruption to his own life and letting him get settled with work or college makes your reasoning a bit circular (you say he has to live with you because you support him, but you are not really allowing him to settle anywhere to support himself) but I understand family priorities may mean that takes second place right now. The more important point in this thread is that you need to understand that your “needing” your brother to spend so much time in the Philippines at best is delaying when he can naturalize and at worst could jeopardize his green card.

Last time when we applied for I-90 we tick DHS error. Can we do that again?

You can try it, but it might not work....and USCIS may end up returning the application demanding payment for the i-90 fee.

The final denial wasn't due to DHS error----it was denied because you sent an insufficient response to the RFE.

Last time it went through until we didnt submit the right response like you said. Should we applied as DHS error again since my brother is filling for a correction again?

What was the error? In the first post you just said you were applying for renewal and he has been in the US 10 years, which sounds about right. Did he have an error in his old card for 10 years, or what? Did I miss further information in another post?

Did you get him a new card with biometrics when he turned 14 as required?

Did you get him a new card with biometrics when he turned 14 as required?

He got his 10 year visa when we got to US 2008. We renewed it and received a new green card but they put his first name twice. So we applied for correction but got denied. Because we sent the old green card rather than the new one that has incorrect name.

Curious why you didn't just send it with the RFE, then...unless the RFE was for something else?
