my advice is to submit a letter stating the situation and that you guys might file soon for a divorce and if that happened that you'll be submitting the final divorce decree. Wait for the RFE and see exactly what they asking for and go from there.

How long they give to answer for the RFE??

They give a MAXIMUM of 12 weeks + mailing time:

"The maximum response time for an RFE may not exceed 12 weeks (84 days). However, when an RFE is served by mail, USCIS officers should include additional mailing time for the RFE to reach the applicant/petitioner and for the response to reach USCIS. The standard mailing time established by regulation is three days."

If it is something very simple, they may give a deadline that is less than the maximum above.
