From what we know. Fastest option is USC Mother petition and When Visa becomes current in 7 years or so. Use to be 4. So it can move faster. When visa becomes current. File I-601A.

 

Dream Act and/or Immigration Reform could pass in near future.

Assuming he isn't put into removal before then, of coarse. And assuming there is sufficient enough of a "extreme hardship" on the parent to have the waiver approved.

What would make a overstay in removal?

Many newspaper articles noting the mere fact of being illegal is enough now , not targeting criminals like the previous administration. Being found out is enough - remember the pizza delivery guy? Ok a judge stopped that but without nationwide attention that guy would be gone. Adrian Rodríguez got deported for not paying a parking ticket. Etc. there are people who arrive for green card interviews and get arrested by ICE.
