i-864 and i-134 question

To adjust you need the I 864 amount anyway.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

here is the thing.  I make 35,800 yearly.  It will be me, my fiancé and her 2 children.  I also have a 11 year old son who lives with his mom.  We were never married and she always puts him on her taxes as a dependent.  His mom and I have no child support documents.   I see my son almost everyday but he doesn't live with me.  I make over enough for my fiancé and her 2 kids.  Will they count my son as well?

Timeline

Rapidvisa advised me to only count the number of dependents I claim on taxes. Uscitizenship dot info says to list those for whom you are the legal guardian. 

 

Both answers would leave me a little nervous without talking to an attorney specializing in immigration

Your son must be included in your household.  It's 5.  

 

The I-864 doesn't work the way you think.  If you don't make enough for a household of 5, then you will need Joint Sponsor for all three immigrants.  You can't just get a JS for one.  You would need to get JS for all three.

The I-864 instructions say to count all children.

If you don't meet the financial requirements for a household of 5, then you would need Joint Sponsors for all three immigrants.

At this point, he needs to meet the I-134 requirements

Use assets. If you're only $1000 short then you only need to show $3000 in assets.

Edit: disregard, I just read you have one more household member. Your child definitely counts.

How can you pass the I-134 and not the I-864 when the threshold's used by Kyiv are the same
