Hi,

I have a few question. My husband is filing N400 based on marriage. He was 26years old when he came here in the US.

1. What should be the answer to Part12 item 44?

2. He has a stepchild (my daughter) who is still in the Philippines, shall we include her birth certificate?

3. How much bank statements should we include as supporting document?

  1. If he entered the US after his 26th birthday then he selects "No" for 44. A.
  2. Your daughter should be listed in Part 11 as a stepchild, but no birth certificate required.
  3. I'll defer to more knowledgeable users (@geowrian, maybe?).

If you mean to provide bank statements as evidence of financial commingling, then there is no precise answer. Some people won't provide any as they don't have a joint account, and that's fine. Others may provide many over the entire period of the account. It really comes down to the totality of the circumstances.

Quality > quantity. Providing multiple types of evidence of a bona fide marriage, including financial commingling, is optimal. If you have plenty of other evidence, then only a few statements is probably fine.

another question for the 5 years address.....we were in Guam from the time my husband arrive until march 27, 2018 and had 3 weeks vacation in the Philippines before we moved to Texas on April 24, 2018. Shall I date the current address from March 28, 2018-Present and Guam from (date of arrival)- March 27, 2018?

On the online filing, it asked for my daughter's birth certificate which we have provided however it also asked for evidence of child support.

and to quote "

Evidence about child support

If you have dependent children who live apart from you, upload documents showing that you support each child and that you have complied with child support obligations. Make sure the text is readable. This may include the following:

  • Images of the court or government order requiring you to provide financial support
  • Canceled checks or money order receipts
  • A court or agency document showing child support payments
  • Evidence of wage garnishments
  • A notarized letter from the parent or guardian who cares for your child(ren)

We can provide online receipts of money sent me as the sender and my mom as the recipient. Other than that, there is nothing else we can provide

Since it's his N-400 application he should upload a statement from himself that says that there is no legal obligation for him to financially support his stepchild; i.e. he has no "child support obligations" for the stepchild.

Thank you both.

I'll just provide at least 1 month of bank statement.

I would suggest at least 1 bank statement on a quarterly basis (4 statements per year) over the past 3 years of marriage.  You'll want to show financial co-mingling through the duration of the marriage...not just once, randomly.  As mentioned above, however, it also depends on the totality of your other evidence.
