Expedite Request for Unique Situation

Hey Guys, 

I don't know if any of you still remember me and my wife's case. We are the couple who sent the RFE after a successful Adjustment of Status interview without the cover sheet and then it subsequently was lost and we also moved in the time frame and the address change was unsuccessful and which lead to our case being denied due to abandonment and then to compound the error, Me the UK Citizen left the US as the letter told me to do so and immediately filed the I-130 Petition. 

We are currently 6.5 months in and are waiting on the NOA2. 

We are going to try to request expedite as we think we may hit a few of the requirements. 
We are wondering if we can request expedite before NVC stage. 

Also what is the best way to go about it. 
We already have our local Congress Woman looking into our case, we are thinking of asking her for help with the request. Is that the best way?

Or calling up? Email or Infopass appointment?

The Congresswoman won't be able to do much for you.  They have no say or control over the USCIS, so can only inquire on your behalf, not much else...

Please don’t listen to people who tell you not to contact a congress person. Every case is different. We used our senator and we’ve had amazing results.

A senator has more pull than a congressman over federal issues.

There is a procedure for expediting, follow that.

  Are you trying for USCIS error as a reason ?   Sounds like it was bad timing , USCIS sent things to the address of record. Might be a hard sell , unless you are saying the coversheet was the issue.

second part of my post was towards the OP.

 

First part was why you were having more luck than the average person, which is where the negative response comes into play.  When you've been here a few years, you find that certain things help and others don't.  So you try to help people by learning from other's mistakes.  I agree the worst they can say is "we can't help" but then you've wasted time and effort into something vs putting towards something else more productively.

No harm in trying, with regard to the OP’s case.

No basis for an expedite seems to be applicable either. A senator can help with requesting it and communication with USCIS, but can’t influence any decision.

Baseless expedites are also a source of delays for people who do need an expedite.

I assume the OP has done whatever they wanted to do by now.

 

My general rule is If in doubt, expedite. I think it is somewhat unlikely for any one individual to consider the bigger picture ramification

True. Although that’s what I did...I had a basis for expedite but can’t bring myself to slow down the process for those who actually need it.

Admirable but not sure how common. The way ot seems to work now is that those in the know get a job offer to expedite and those not wait.

Also true. Although this was for AOS itself (which yes, I know is rare unless it’s due to a deployment or something).
