I know it’s hard to travel on a k1 after you’re in the USA for the first two years.. does the same apply for kids on a k3?

After you enter the US on K visa, you cant use it for travel anymore. K visa is one time use. In order to travel you need to file AOS and I believe children will be included- and they also cannot leave US until they receive proper permits. 

K1

29.11.2013 - NoA1

01.04.2014 - Interview.

03.2015 - AoS started.

09.2015 - Green Card received.

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

The K1 is no longer valid after it is used. Like already mentioned, it is a one time use for entrance only. You can no longer use it for travle after you have used it to enter the US.

 

For anyone on a K visa, in order for them to travel, they have to apply for adjustment of status and apply for AP which authorizes them to reenter the US after they travel abroad. The current processing times to receive AP is 4 - 5 months.

K-2* (K-3 is obsolete and for the principal applicant, not derivatives like children).

 

The K-2 must be issued within 1 year from the original K-1.

After filing for AP/EAD with AOS, it's currently about a 5-6 months wait for the AP/EAD card. 

AP is what allows a person to come back to the US to finish AOS after leaving the US.  If a person leaves without AP while waiting for a green card, then the case is automatically cancelled.  

 

AP is received as a temporary authorization to return to the US after leaving that is received during AOS.  Once AOS is done and the person gets a green card, AP is not needed.  The green card then allows the person to leave the US and return.  

 

So, be careful.  There are two different documents at different time allowing a person to return to the US after leaving.  

 

Why the need for the K-1 and K2s to leave?  What's the issue?
