I am also in the same boat. So basically, I can file as married filing separately and once my spouse arrives to the US and gets SSN, I can amend my tax so that I can get my tax return right?

You can definitely file as married filing separately if your spouse doesn't have a SSN. I would assume you could later amend it, but I would speak to a CPA or tax attorney as I haven't researched that particular scenario. If you amend later to file as married filing jointly, you are potentially eligible additional deductions and exemptions that could be beneficial to you, but your spouse's foreign income would also be subject to US taxation. There are a couple of ways you can avoid paying tax on foreign income (through the Foreign Earned Income Tax Exclusion or the Foreign Tax Credit) but there are limits on these. Basically, it all depends on you and your spouse's specific financial situation whether it would be more beneficial for you to file as Married Filing Jointly or Separately. Sorry I can't be of more help on this point!

If you were considered married during the tax year, you can't file as Single or as Head of Household as both of those filing statuses are for people who were considered unmarried for the tax year. (Source: https://www.irs.gov/newsroom/determining-your-correct-filing-status)

If your spouse doesn't have a SSN/ITIN, then you would select Married Filing Separately as your filing status and you have to paper file your return. This is because electronic filing platforms won't allow you to leave the spouse SSN/ITIN blank, but a paper form will. I don't know if it's strictly necessary, but I also attached an explanatory statement to my return when I filed noting that my husband is not subject to US taxes and doesn't have a SSN or ITIN and the return was accepted with no issue.

That is not correct, I married in 2017  and filed my  2017 tax return as head of household. I researched IRS website before  I did. My mom and dad qualified me as head of household. My husband is in Ghana, he doesn't have SSN or ITIN so I have the option to file as head of household.

Hi there and welcome!

I’ve received a case number after 9 weeks.

Some embassies recently changed from mailing processing to electronic processing so best thing to do to be completely sure is to call and ask about your Embassy method on how to submit documents.

I’ve got a Case Completed in 9 business days.

Its been a week i’ve since I received CC and I’m currently waiting for an interview date -i will get one accordingly to available slots from my chosen Embassy. So check with other VJ members how long it’ll take to get one in Haiti

Good luck to you and call to find out :)

here is link how to upload file to CEAC. I hope u can complete ur case as soon as possible.

Interesting. My apologies, I'm just quoting the general rules per the IRS website https://www.irs.gov/newsroom/correct-filing-status (this is a more up-to-date link than the one I previously shared). You must have qualified for one of the special rules they mention that allow for HoH filing. For anyone keen to dig into the detail, all the rules are laid out in Publication 501: https://www.irs.gov/publications/p501#en_US_2017_publink1000220818.
