No I did not say or suggest that, but I was just providing you with a helpful tip if PF was on hand :)

You may either:

1- Wait for a PF then send it with the receipt

2-Wait for the RFE as your lawyer suggested (look into the uscis updated policy regarding correspondence & RFEs)

3) You may send a copy of the supporting documents along with a cover letter and a copy of your i-360 receipt to VSC and schedule infopass if appointments are available. (double check with @sandranj)

At the end of the day, don't panic if everything else is correct, some of us did not submit a psychological evaluation and VAWA was approved based on other evidence.

Oh ok. Thanks for the info. My concern also is with the new policy memorandum that they wont send RFEs anymore. My receipt date is 9/11, does that affect my case or only cases with receipt dates after 9/11? Thanks so much for taking time to respond to my questions. I really appreciate it 😊

Hello everyone.

So I had my i485 interview this morning. Scheduled time was 8:30am,  I was called in 9:15am there about. The interviewer was so nice. He asked me the questions that were on my i485 form. He asked me if I am divorce and I said yes. He took my medical then he asked for my affidavit of support. I told him I didn’t know that I needed one and he said he is not sure if I do but he was going to look into I later. If its required he will request it in writing.

He later handed me the interview result, which states that the case will be reviewed.

Folks pay attention in all documents that you are submitting to USCIS, if your name is mispelled wrong in any document that you are submitting to USCIS such as utiliy bill, health/car insutance, bank account, lease agreement etc, YOU MUST INCLUDE police clearance with every single name. For example your name is Mary Lucy Smith, but some bills are showing your name  as Mary Smith, or Mary.L.Smith, or Mary Lucy you have to get police clearance with all name versions ok, even in case of mispelled name.USCIS  will not issue RFE to ask police clearance  anymore,if you do not submit all names used in administrative documents  they will deny your case.

If you know that all evidences were not submitted then submit  when you get the receipt number. Most likely USCIS will not issue RFE anymore asking documents to prove good moral character, abuse and/or bonafide marriage.

Thanks @sandra and @iwillsurvivefor the info.

am a bit confused here,do this policy applies to all applicants or those who file after September 11 .

i file in May,does the policy affect me as well or applicants that file before September 11.

If yes does that means it’s compulsory and mandatory to send other evidence before the final decision on each case.

Thanks

VAWA is not considered humanitarian application.Humanitarian application is for people living here with TEMPORARY PROTECTED STATUS,countries such as Somalia,Yemem,Honduras etc.

Thank you.. I'm so stress about it... Another question if you haven't committed any crime here or homeland, (i came with tourist visa and after couple of moths i get married after 3 years of abuse i decide to apply for vawa) and haven't use any program ( federal aid, to consider public charge ) under what ground can be an i485 being denied?

I'm pretty sure that i360 have all the evidence to prove domestic violence, the bonafide married and the residence, but have heard cases where this form has be denied. Thanks again

I honestly don't know but I suppose it may apply to your case since the memorandum was in effect as of 9/11 as well, so  just to be safe mail a copy of your documents  along with a copy of your receipt. addressed to the VAWA unit at VSC. It won't hurt to be safe and if accepted you won't suffer RFE delays, so nothing to lose here.

It simply means you should gather all required evidence/documents  needed to approve your petition before you submit, however they may or may not  in their descretion issue rfe when not satisfied, make sure to submit all initial documents with your applications and it applies to all applications.

Okay thank you .. Now I got it .
