It simply means you should gather all required evidence/documents  needed to approve your petition before you submit, however they may or may not  in their descretion issue rfe when not satisfied, make sure to submit all initial documents with your applications and it applies to all applications.

3. Divorce doesn’t affect VAWA at all. 

 

4. Yes, you need the appointment letter to take to the biometrics appointment as proof that you got invited to have the biometrics done. Otherwise anybody can just walk in. Just ask your attorney to send you the original. You pay her/him, they work for you, so just be firm.

    I will to see my attorney next week. nad ask her to apply EAD card (c9) , if she does not let me and I will break up the contract with her. 

    I have new questions for you or anyone who knows the answer, help me please. 

    1. My divorce deceers alrelady in hand , do i need to send these divorce deceers to Verment service center before they ask ? I dont have any RFE yet. 

     2 does it will delay my case if I remove attorney from my VAWA case?  how to take her off from my case ? how to change mailing address to my address ? 

         my attorney is very not good. she hold all my documents for over 5 months since i gave to her  but did not sent them out , aftetr i asked her so many times , she finally sent them out with missed a lots of document i gave her in July.  she does not let me to apply EAD card by the C9 with my I485 together but choosen the C31 only.   also she only put her address on the forms , i did asked her to put my mailling address together so i can recive the copy form uscis too but she did not. 

    when I emalied her so many times to apply EAD under C9 but always no answer to me , so I   asked her in person  to apply EAD with C9 last week. but she said she already changed , it is auto changed to C9 from C31, so I do not need to apply it just need to wait uscis send to me ! i was belived her and came back to home , but think that is not right . how it can be auto changed without my sign and did not closed the I765 she applied for me with C31?

    3. i applied i485 , so i think can apply i485 and i 765 for my chidren as you and SANDRANJ said.  

    4. I did finger print . 

    5. how to ask prima facie ? do i need to write some finance hard ship on the letter ? 

    6. how  long does it take to get approved i765 (C9) ? Do i need to ask the fee waiver ? or i dont have to ask fee waiver just only send the I765 with my I360, I 485 recipts ?

You won't have problem because is expired,but you MUST renew your passport.You can't attend AOS interview later on with an expired passport.

Hello everyone👋😁😁 did y'all notice the retrogression of 1360 processing times? I mean just yesterday it was Jan10th..now it moved back to Dec 29th..also the total processing times just increased😟😟😟😟😟😟 ok shoot me now!😥😥😬😬😬😬😬

So VAWA is considered as humanitarian application? If our cases are denied will.NOT send an NTA  for future deportation?

VAWA is not considered humanitarian application.Humanitarian application is for people living here with TEMPORARY PROTECTED STATUS,countries such as Somalia,Yemem,Honduras etc.

I MOVED last year and sent change of address to Vermont but they never replied back, I sent them three letters as follow up just to know if it was ever changed, the last letter I sent after 3months of the original request, then finally I received a mail from the supervisor confirming she just updated my address, she also noted that my second prima facie was sent to my old address over a month ago and I missed it. I moved again and sent change request to Vermont July this year, till now no responds but however I did set up mail forwarding with USPS and I was able to get my RFE they sent me in August even though it was mailed to my old address. I would suggest you do same while you also follow up to make sure they effect the change.

@Favoured Queen👑 They did this before, just don't count on the processing times altogether because they are not very reliable or consistent, I guess it's just meant to provide a general estimate.

1- You don't have to submit the divorce decree now.

2-It will not delay your case.To terminate your attorney representation send it a certified letter to her,and inform USCISthat you will represent yourself.

3-Apply form I-765 for your children if they will work, otherwise do not  file form I-765

4-Write a basic letter asking to issue prima facie because you want to apply for example to obtain medicaid or fafsa etc

6-90 days.If you are submitting the I-765 after you submitted form  I-485 you need to pay USCIS fee or ask to waive the fees. There is no fees to renew the EAD using same category.

You will hear something in the near future and you can ask your representative (congressperson or senator) to inquire about your case on your behalf, but don't worry it's been taking most people a long time to get updates on their vawa applications yours is within the norm so far. Hang in there :)
