Please could someone offer any advice on completing question 12 in part 4 - we do not have an address in the USA yet where I (the beneficiary) intend to live..as my husband (USC) lives here in NZ.  He is planning to reestablish a domicile but we do not have a US address yet.  Im not sure we are able to leave the question blank..if I put “same” as the form states then that will be my address here in NZ not a US address. Has anyone here on this forum struggled with this question and completed it successfully?

Hey, I’m a kiwi who was in a similar situation, we had to reestablish domecile. My wife (the USC) had been out of the US for over 10 years. She no longer had US bank accounts, drivers licenses or anything.

 

i don’t have the I-130 handy to confirm the exact question you need help with. For us we put our NZ address for all questions except where we intended to live. For this we put the address of my sister in law in Arizona. You can always attach a further explanation using a supplemental page with detail on your address situation and you plans to re-establish domecile.

 

The burden of proof for re-establishing domecile is higher but it can be done. Let me know if you need the list of what we submitted at each stage.

 

I entered the country three weeks ago and am now setting up a life in Arizona. So I can attest that it’s achievable. It took us 18 months from I-130 submission to a visa in my passport. This was with no issues or RFE’s.

01/18/2017: I-130 mailed

02/13/2017: NOA1

10/30/2017: NOA2

NVC

11/22/2017: NVC welcome letter received (by email, paper copy arrived weeks later)

12/07/2017: Filled in DS-260 online

12/08/2017: Posted NVC package (AOS, IV & Civil Documents)

12/18/2017: NVC Scan date

02/01/2018: NVC Case Complete

03/02/2018: Receive Interview Appointment letter

03/20/2018: Medical appointment

04/17/2018: Interview, result: APPROVED!!!

04/24/2018: Visa Issued and shipped from Consulate

04/26/2018: Visa received!

06/21/2018: Landed in Houston! Passport stamped :)

07/14/2018: Greencard arrived in the mail

Hi, apologies for duplicating my post. However, the post you removed had replies as I can see them in my notifications but I can not view them now as my post has been removed. Can you please tell me what the members responses where to my question?? 

 

I posted on the other forum as it was specificically for poeple applying from New Zealand/Australia. If I am unable to post in both can you reopen my post on that forum and delete this one.

It doesn’t matter where you are applying from - the procedure is still the same. Many people are in the same situation with no known address at this stage. You can write “to de determined”. If you know which state it will be, you can add the state but this is not required. 

 

We also had no address at the I-130 stage. My husband was sharing a place with a friend of his and the lease did not permit more than 2 adults in the apartment and we wanted to have our own place anyway so we knew we would not be living there. So we wrote “to be determined, Washington state”. No RFE

 

 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Myself,  I have established domicile before i submitted the i-130 just because of that question.  I did not want anything to be left undone.  We are in no hurry to move, but I just wanted to make sure I leave no questions unanswered.

Completely unnecessary to establish domicile before submitting the I-130.  Good idea to have a plan though.
