How does this look for bonafide evidence?

Thank you all for your help.  hoping to send package on monday

 

Timeline of our relationship with photos and letter

  1. Copy of birth certificate of our deceased son  ******
  2. Copy of birth certificate of our 8 month old daughter ******
  3. Copy of all pages of M’s U.S. passport indicating visits to Costa Rica and consecutive time spent with KAPH in Costa Rica and Panama
  4. Copy of pages of daughter’s U.S. indicating the 4 months spent with mother and father in Costa Rica, including a family trip to visit Bocas del Toro, Panama to see more family
  5. Affidavit signed by H, mother to the petitioner MMD and mother-in-law of the beneficiary KAPH 
  6. Copy of pool passes from neighborhood pool showing joint residence at MMD’s parent’s house.
  7. Copy of car insurance on the Donovan family car with USAA for KAPH

The best documents for evidence should have names of BOTH spouses on them. What about financial documents,  tax documents, etc.?

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Is this evidence for Adjustment of Status?  If so, I think you need better evidence, to be honest.  You should be able to show financial mingling, healthcare documents, insurance documents IN THE USA..  Trips together won't be enough, imo.  You have a life together here in the US.  You need evidence of your life together here...

I agree that you seem to be lacking good evidence and no financial stuff there.

 

We have already:

 

a) Proof of joint account at local credit union

b) credit cards in joint account(s)

c) beneficiary from my work 401k, medical HSA account, work travel insurance and more work stuff

d) mail from different sources government, private mail (friends and relatives), other non governmental mail pieces to proof address

e) apartment lease with both names on it 

f) Working how to get her name on my current loan for my car, close to getting her a vehicle for herself also with both names in registration

g) other legal documents where my wife is beneficiary at not related to work...

 

sorry, but your evidence is a little insufficient on proof of bonafide marriage.  we have this in less than a month of being married already and working on more, lower level of acceptance, photos, trips and such

I guess I though kids together would be the strongest evidence, but I will work on getting more financial ties.  My bank won't let him be a member without SS# but I think I could fine one that would let us open a new account together.

health insurance, Health care proxy statements, life insurance, rental lease, utility bills with both names or same address, wills, trusts, car title with both names, etc.

Has his I-94 expired?  If so, I would get the package in the mail asap....and get as much quality evidence as possible before the interview.

No, we have only been here 36 days, but circumstances just changed and so we have decided to stay.  Really it is an EAD that he needs ASAP.

Most solid?  Maybe......But finance is an area that "most" couples share in a marriage.  Officers look at the totality of evidence, hence, financial documents, health related documents, and others that most marriages generate hold weight, imo......

That makes sense, but children are strong evidence too right? Otherwise I'll wait another week to submit until I can put him on my life insurance and get him health insurance and make a joint bank account.  Right now he has travel, bc this was supposed to be just travel. I am the beneficiary on his travel insurance, would that count?

I have heard that having children together is not evidence of a marriage, and others say it is.........I think the insurance documents, and a joint bank account would strengthen your file enormously....good luck.

I'd say don't rush and submit as much proof as possible otherwise an RFE may significantly slow down your case. I agree having a child is a very strong evidence, but it may or may not satisfy the USCIS officers who are going to review your case.

 

Get more financial/insurance documents with both names on, photos of you two with family or friends, wedding details (photos, receipts of rings, bouquets, catering, etc), if you rent an apartment, put him on the lease; if you own a house, at least put him on the house insurance document, postcards from friends, communication records.

 

Just remember that the officers know nothing about who you are and what you two have been through together. And now you have to convince suspicious strangers that you two are married as a couple only with the application package you're sending in. Anyway, the more evidence the better.

I dont want to cause a tsunami out of a glass of water, but the evidence needs to be gathered while the marriage is going on. We did a k-1 and as such i gathered as much evidence as possible throughout my relationship with my then fiance. She is my wife now and i jump started the collection of evidence for bonafide marriage. IMO, last minute evidences...seem a little to convenient for the IO to look at. There was one case of a not so long ago interview for ROC i believe where the issue with the new looking debit card of the beneficiary was questioned. A VJ member that is. If you are close to getting interviewed, much needed to be done prior and discussed what possible questions would come to light. Of course no marriage is perfect and nobody wants perfect 100/100 questions answered correctly because suspicion arises, but some real proof is the financial part. The paper evidence usually does not lie and speaks for itself

Hi Nancy! Thanks for your reply.  We have loads of pictures as we have been married for 2 years and together for 4.  We have 2 kids together and family photos and affidavits, so lots of evidence of that sort.  My dilemma is that while we have a joint account in Costa Rica and just got him on the car insurance. We are living at my parents house (no rent or way to add him into anything there).  And we are just starting up a life here.  But we desperately need him to start working.  My mom has cancer and I'm taking care of her and the baby and we have like $0 haha my dad is the joint sponsor.  I am trying to figure out how to prove this and I just feel like no one will believe it because there are no big financial ties. 

 

only taxes, health insurance, life insurance and joint account in Costa Rica....
