Difference between IR1/CR1 and K3 visa

IR1/CR1 is what you want to go for.  It’s the same process for both of them, but depending how long you have been married when your spouse enters the US will determine whether she gets the IR1 (married 2 years or more) or CR1 (married less than 2 years)

 

K3 visa is essentially extinct.

One process.  The age of the marriage chooses the visa classification so you don’t need to worry about this

As others have said, CR1/IR1 is the way to go. K3 almost never happens anymore.

 

So basically, K3 was created with the idea of bringing spouses together while they awaited the adjudication of their CR1/IR1 case. Since the processing times are almost the same now, this makes the K3 essentially worthless.

 

I fell into the K3 trap (not that it did me any harm, it just wasted my time). I filed for the CR1/IR1, then filed for the K3 thinking I would get my wife to the USA faster. USCIS actually closed my K3 (I-129F) petition 6 weeks before they adjudicated my CR1/IR1 (I-130) petition. That means that they aren't even playing by the "time" rule anymore. They are literally closing K3 petitions even if they get to them first (which isn't supposed to be how it works from my understanding).

 

With that said, I'm still VERY glad they closed my K3 petition because the CR1/IR1 route is much better. The CR1/IR1 gives permanent residency immediately upon entry into the US. K3 would require an adjustment of status, which is lengthy and expensive.

 

Sorry for the book, just wanted to chime in on the worthlessness of the K3 and how grateful I am that it got closed in my case in favor of the CR1/IR1 path.

Actually, that's not how VJ works.  Immigration advice by private message is discouraged.  Ask your questions in the applicable public forum, so others can benefit from the discussion and errant advice can be corrected.  THAT is how VJ works.
