Social Security card and new marriage

Timeline

My wife came into the US on the K1 visa. We were married at the beginning of the week, and went to the Social Security office to get her a SS card with her new name. We were told by the clerk there that we should go to DHS and let them know we were married, and that the SS card wouldn't come through until after that.

 

Has anyone else gone through this process? Is he referring to Adjustment of Status? I'd hate to think we need to wait for that process to complete before she can get a social security card. I'm going to call tomorrow, but I was hoping for some clarification before then if anyone else has gone through the same.

Well what messes things up sometime is trying to get the SSN in the married name when one comes in on a K1. Go back to a different office if you have that option. Try to get it in her visas name. Her ID and Visa need to match what is in the system. Some ppl are able to get it in their married name but many more have issues. Once she gets the card then she can go back and get it changed.

We were able to apply for the card just fine. He just insisted that we needed to go to the "101 W Congress building" (USCIS Chicago) and let them know we were married, that would trigger something in the system, and the card would be mailed to us. It seemed a little weird. I'm sure we're not required to wait until we've adjusted her status, and that's the only way I know of informing them of our marriage.

A few questions:

 

Was she listed in the I-94 system correctly? Give it a check online.

 

Is the SSN actually being issued or is there a delay on it, as in they couldn't find her in the system and told you they'd have to wait for some checks?

 

Did you try to apply for the SSN in the married name instead of her current visa/passport name?

 

You do not need to go anywhere, or to any office. That's nonsense. Marriage is in the domain of the state, the feds don't need to be 'notified' of anything. They have no control over the SSN being issued. It's the SSA's job to issue it. You do not have to wait until you AOS to obtain an SSN. In fact it's often better to obtain the SSN before marriage, which is also perfectly allowed to do. If she's in the I-94 system currently and correctly, then she'll be in the system. If you got a dud at the SSA counter (which is common) ask for supervisor or go elsewhere.

Yes, we applied for the card in her new name. We received a receipt, addressing her in her new name, stating that we applied for a SSN and that they needed up to 4 weeks to verify the documents we provided.

 

We provided her passport, a printout of her online I-94, and our marriage certificate.

 

The receipt gives a number to call, so I guess I'll just get ahold of them tomorrow for clarification. I'll post back here with anything I find out. Thanks!

That's going to be why. I-94 won't match her 'married' name, but will match her maiden name - thus they can't find her in the system properly, meaning a delay. Unfortunately there may not be a lot you can do in this regard, until AOS (and at the earliest when you have the EAD in the new name). But sure as heck going to some DHS location in Chicago isn't going to help one bit.

They are probably referring to USCIS issuing of SSN cards. When you file for AOS you are given the option to choose if you want USCIS to get you a SSN. If you don’t wanna do it yourself and/or won’t need the card or number for anything until your EAD is approved you can check the box on your I-485 form asking USCIS to issue you one. You’re much better off doing it yourself. All it takes is a trip to the SSN office with ID and a copy of the I-94 and fill out some forms there. 

 

However if you already filed for AOS and checked the box asking USCIS to issue you one, you’re stuck now.

I think this is the same current issue for us. POE for my then fiance was 7.28.18. Applied for ssn day after, got married 8.18.18. Went to 2 different offices that give different excuses why she can't get her new ss card with married name. One said she needed to wait until getting her green card. Another said she needs to change her name on her chinese passport at the nearest embassy which is in chicago (we are near Detroit), or we needed to file some F1 certificate (?). Good friend of mine did the same as we did, had no issues. So now we are going to where he filed where they process more asian immigrants at. 

Did you ever resolve this on your end? Hate to think that you need to wait so long just to change your name so we can get a drivers license/State ID and bank account.

we went through k-1 and we did not o what OP did. We applied for SS# first and hours later got married. It took us 4 weeks to get a SS#. Unfortunately since you guys did it after marriage....you are going to have to wait for EAD
