Hi All,

 

My husband got his conditional two-year green card last October. I know we have to apply 90 days in advance for the conditions to be removed before it expires. I have a few questions for anybody that had done the removal of conditions:

 

1) I read we need to show proof we spent "ample time together". I have copies of our leases (he was listed as tenant on the first one, we never updated it add him as a co-leaser), our bank statements, joint credit cards, our new lease that has both our names (moved to another state). old utility bills that have both our names, car insurance, saved cards from my family and even show he is the emergency contact for our pets. We are not picture people...either of us so nobody is taking selfies nor are we asking people to take our picture. I think we have 3 or 4 photos of us together the whole first year. I was wondering if i should stock on photos of us together in the upcoming year? We usually spend most of our time together at home since we are both homebodies and he's not a fan of my main hobby (horseback riding). 

 

2) If we are assigned an interview, how will he be allowed to keep working if the interview is after his current two-year green-card is set to expire? Do they extend the green-card if we submit all the paperwork and are waiting on immigration to process the removal of conditions?

After you submit the paperwork, they send you an 1-year extension letter for the green card.

your evidence looks good I will not worry to much about pictures. Me and my wife do not take to many pictures either most of our pictures is of our baby daughter . I think I only sent in maybe 4 or 5 pictures of us

The other evidence is more important your joint bank account, joint credit card, lease agreement with both names are very good even so you might see if you could get  more and concentrate more on that then pictures 

Once you submit everything you will receive an extension letter extending your green card for one year it is good for one  year from the  expiration date of your Green card not the date of the letter

Hopefully NVC has speed up the process when it is time for you to file for ROC. Right now NVC is very very slow

Just a slight correction, NVC which is part of the State Department does not process ROCs.  This is done by USCIS service centers (California and Vermont) which is part of the Department of Homeland Security.

 

To the OP, your evidence looks good and you can only send in what you have.  One thing we did was to get wills and living wills as well.  As to proof of LPR status, as stated,when the ROC is submitted, USCIS will send you a one year extension letter valid for one year of the expiration date of the two year GC.  Your husband will use the original of the letter along with the expired GC to prove his LPR status for work or international travel.  If processing times do not improve, he may need to go to USCIS via an infopass appointment to get an I551 stamp in his passport which is valid for another year.when the one year extension letter is about to expire.

Pictures don't matter for ROC, I sent maybe 2 or 3. They want to see joint accounts, leases/mortgages, utility bills, insurance policies, legal documents (POA, wills), both of you being each others' beneficiaries (of IRAs, 401ks, life insurance), documents showing you both live at the same address, that you filed taxes jointly etc. You want to send in stuff dating as far back to your marriage date as possible up until the current date. Don't just send in one or two statements for everything because they'll likely send an RFE for the rest. In our case, we were CR-1 so we didn't really have anything dating back to our marriage, but we showed what we had been doing since I moved here and it was enough to warrant an approval.

 

If you don't have some stuff that would be considered standard then you can explain why in your cover letter. We have never had joint utilities, but in my letter I explained that we paid the utilities by splitting the costs and putting the money into our joint account. We pay all of our bills from it but put our pay checks into separate accounts.

Clarification on how much evidence to send in

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
