Hey guys! I have a question...My husband didn't file the 2017 tax returns yet and he wants to file as married but we are close to send our documents to NVC. Is there some problem if he sends like this? It would be 2015, 2016 as single and 2017 as married. Also I don't live with him yet, I'm in my country waiting the process ends. If there is some problem then could he send 2014, 2015 and 2016 as recent tax returns? Thank you!!

he can file married filing separate, and once you get here he can adjust to filing status and amend the return.

 

if he wants to file Married filing joint, he would need either your actual passport in his hand or a certified copy from the issuing agent, a W7 would need to be filed out and signed by you as well as 2017 tax return and mailed to Texas to obtain a ITIN number.

 

I just did this with my husband and his actual passport which has my anxiety up in reals right now, I am set to go back to Egypt to visit and I hope his passport is returned back to me in time.

 

but if he gets to NVC stage and there is still time to file taxes it is perfectly okay for him to use 2014,2015,2016 taxes.

Just one more question...if we get to the NVC stage, specifically to send the financial evidence and he didn’t file yet the 2017...is it still good send the 14,15 and 16?

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I read you can use the prior tax returns until the current tax season is complete. US taxes for residents are not due until April 17. I am sure after April 17 they will expect petitioners submitting tax info to be up to date.

 

I am at the interview stage and submitted 2014, 2015 & 2016 for previous tax years and they were accepted.

Hey guys! Me (beneficiary) and my husband (U.S. Citizen) been reading more about this tax returns stuff and now we are really worried. What made us wake up about his was the Khallaf's help. Well me and my husband got married on October 13th, 2015 and since then my husband kept filing as a single person. (He didin't know anything about this!!!). Our situation right now is...we are waiting the NVC gives to us the CS and the IIN and then we can go forward. Probably they are going to give to us soon because the case was sent to a supervisor. The thing is...we already know that everything we do for IRS, it will take a loooong time. And propably we will have to send the documentations to the NVC soon. So what are your suggestions? Please! Also, he is military and he is in a military course right now and will be back at home only on March 1st. Now I'm in panic!!!!! I tried to delete this post on another thread because I think here is the right topic to be discussed.

no need to be in a panic, if he just needs to download the amendment forms from IRS website, go back and correct the 2015, 2016, and 2017 tax returns if he filed the 2017 already. He needs to make a copy of those amended forms so that you you can attach them to the incorrect forms when sending to NVC it doesn't take days to complete an amended form, it only takes the IRS time to acknowledge them. he needs to get them in the mail to IRS and with the copy of the amended return attach them to the original one that he filed. write a statement explaining the reason for the amended forms. 

 

It is simple fix, but this way it will not raise the red flags with NVC or the CO at interview time.

with us, we have to mail in all our papers and evidence to NVC, so we have a little bit of extra time since NVC stage for us can't ALL be done online.

 

just take a deep breath it will all be okay, this isn't a huge hurdle to overcome, it would be a problem if he didn't file a tax return at all, but this is so simple to fix, and if he needs help you can send me a message, I had to amend a return last year, and this year I had to send my husbands passport in the mail to get his ITIN number, I am praying it gets back to me before I have to leave for egypt to give it back to him as sending it in the mail overseas is so expensive.
