Problem....

We are getting married oct 21, and went i  today to have our medical stuff verified and handled by a civil surgeon. In our forms, we list her name with my last name as we will be married when we submit our aos packet. However the doctor is saying we cannot do this without an id. We are in texas. To get an id, we need a ssn. To get a ssn, we need an ead for work. So how do we submit our aos packet? Do we leave her maiden name on it? So confused as it seems each step requires something done that cant be completed without another

When did your wife arrive in the USA?  Does she still have 2 weeks left on her I-94?

use your passport as id. at the time of your medical you are unmarried and then submit under your married name they will understand the two names.

She arrived aug 31. I dont know how long i-94 lasts? As they moved i94 to all online we only recently found out about it when doing aos forms.

It's 90 days for a K-1. So you have over 2 weeks left and can apply for an SSN fine. However, they may not issue it in the married name...some want to see the new name on a document from DHS first (i.e. an EAD).

 

Correct. You can use the married name on the AOS forms (and list the maiden name under other/previous names used).

You don't need EAD to get a SSN card. Take the passport, Marriage Certificate, I-94 and go to the nearest SS Administration office and you can get a SS on your new name.

It's very YMMV if they will issue it in the new name (but can at least issue it in the old name). My local office will not do this with only the I-94 + marriage certificate (we tried twice). They need documentation of identity in  the new name from DHS first. Another office may treat it differently (and has done so for others).

I don't know why they have different rules or every state's SSN Admin or maybe the staff are not aware. Two weeks after i entered the country, I walked in with Passport, I-94 and the application form and got my card in 2 weeks and for my wife (USC) all we took was her birth certificate, marriage certificate, old ssn card and the application form and she got her card within 2 weeks.

I 100% hear you. My wife and I are heading back to the SSA office again today with the I-485's NOA1 (plus all the other items noted) to try again. Fingers crossed. If that fails, we'll go to another SSA office. I know others had no issue doing this, but they were firm in needing to see that the identity is confirmed with DHS and they needed to see a document with that info first.

Victory! They refused to issue the card in the new name with only the I-94, passport, and marriage certificate. But when asked for the EAD, we gave the lady the NOA1s. I also had about 25 pages of SSA policy manuals ready to go. It took her a while (no hassles with us...just lots of typing and searching), but they finally got it through in the married name.

They refused to change my name on it just with the NOA1 without EAD.

lol yea...i had to take the SSA policy manual printouts when I went to the SSN Admin office because in one of the manual it clearly shows that a person with K1 visa can be approved a SSN. I had to do that because a few people (including you) had problems getting a SSN but someone on VJ told me about the manuals but looks like the officer at my local SSN office knows the rules and so I didn't have any issues.

Ugh, it's awful that they aren't consistent. Reading through the SSA manuals, it states that they are to accept a legal name change document (i.e. a marriage certificate) so long as it is issued after the last form of identity documentation. I was ready for a fight but the lady was really nice and knew what she was doing (praise the flying spaghetti monster!).
