Hello,

On Monday, September 25th, I was alerted via email that I had an RFE coming my way. I received it in the mail yesterday (28th) and sent it off the same day visa priority express mail such that USCIS should receive it today. I am wondering what (if any) the average times to get approval are after USCIS receives an RFE. I realize that, as with anything dealing with USCIS, there is a pretty large span of time, but I was hoping some of you may have experience with RFEs and could provide some insight! It was a pretty easy fix...they wanted my passport biographic information page to go with the scans of my passport stamps I sent in as evidence of meeting once in the last year.

Been running 10-14 for an average. Some longer some a hair shorter.

You are not allowed to travel outside the country until your AP is approved as a part of the AOS. You can't really work until the AOS is completed either. I think the average was 3-4 months, but this used to only be 3-4 months as well so I have no real good idea. We are planning to have the same lawyer we had do this application help with the Green Card and other papers.

Hopefully you haven't visited too many places in the US before and can take some time to wander.

In the mean time you of course are able to get your drivers license and all your other paperwork done.

Is the AP a one time only use? or its like a "passport" to go in an out as long as it isnt expired?

https://www.uscis.gov/greencard/while-application-is-pending

https://www.uscis.gov/green-card/after-green-card-granted/international-travel-permanent-resident

The short answer is that AP is a permanent thing, but you need to get your I485 finished first. If you try to leave before the I485 is completed you need to get an emergency authorized I-131 done to come back otherwise they consider the 485 to have been abandoned.

If it’s filed at your local field office, check processing times here.

When you apply for AOS, you can include an application for Advance Parole (AP) and an Employment Authorisation Document (EAD). The AP allows you to travel while your AOS is processed, and the EAD allows you to work. Those two take about 3 months to approve. If you include them in your AOS application, they are free of charge. The AOS will likely take longer than 4 months so it is good to get those two while that happens.

For what I've seen lately EAD and AP are taking longer now, around 5 months (kind of a similar thing to what has been happening to NOA2), while I'm not completely sure about AOS, but it seems to be around 9-10 months minimum right now
