Denied travel with expired green card and I-797 Notice of Action

What did you end up doing? My husband is planning on going to India for a few weeks (with Emirates) and reading all these stories made us nervous. We just got the I-797 NOA and his GC expired a few days ago. The I-751 was received 2 days before his GC expired. My gut says not to travel, but with long waits, I feel badly for him. :(

I’m actually in India right now. Had to travel to meet my dad who’s been sick. I just took my expired GC, I-797 NOA and valid passport. I’ll be back via United Airlines direct flight from bombay to Newark. I canceled my Europe layover flight.

He will fly with Emirates via Dubai, I checked with Emirates and know that they accept the I-797 accompanied with an expired GC and valid passport, but what we worry about is the check in process via Delhi. The Indian customs officers while boarding to be exact. What if one refuses to accept this...then what? 🥺

Hi there. Thanks for the response. Hopefully it will be okay. I was worried too mainly from indian officials. Tricky but it I think they will be fine. If at all three don’t let your husband fly. Best is to book a direct flight to US from India. 

 

Once i I complete my trip I will certainly post here.

The problem is not the flight/check in part per se -- it is the Customs Authorities (in Delhi Airport) that grant the clearance to pass, is what happens to worry me. So booking a direct flight won't matter if he cannot convince the Delhi Customs Authorities that the I-797 is an official document. He won't even be able to get to the gate where his plane is.

 

I saw the processing times can be 18 months...but let us see what happens in a few months.

Hi There @amul I traveled back yesterday with my G.C (expired) plus extension letter (18 mos). There was no problem from Mumbai officials. they were aware of it and let me go smoothly.

Also when I landed in US, it was easy as I have Global Entry and I spoke to an officer who helped updating my date for another 18 months. All in all its all good.

Yes dont worry. Just present your expired GC and passport first always. when they ask its expired, just present them the 18 mo. extension letter.

Hi all, I'm also planning on traveling from SFO - Mexico (City) and my conditional green card is now expired and I have the 18 month I-797 Notice of Action for travel.

 

I am an Irish citizen / passport holder - and I note Irish passport holders do not need a visa to enter Mexico for vacation.

 

Question: Can I simply enter Mexico via SFO (where I live) using my Irish passport - and ignore all the expired green card / I-797 NoA / visa issues?  ... Or will they regard me as a US resident with an expired PRC who needs a visa for travel?

 

Thank you for any insights you all may have.

To follow up for others with similar predicaments:

 

I went to the Mexican Consulate today to apply for a visa (no appointment, ~30 min wait) and was told by the visa officer that as a citizen/passport holder of a country that waves tourist visas for entry to Mexico I would not need to apply for a visa, even under the expired green card / I-797 NoA circumstances.  Obviously I will need to travel with this documentation to regain entry to the US. 

 

Hope this is helpful information for others.
