Consul asked if she tried to take visa before and my mother told her no

That is unfortunate, but when we say bend the truth (lie), we do this with intent to deceive. It is done by choice and when it catches up with us, we need to face the music.

She now knows not to lie and will need to face the consequences of her actions. I would say, go in there, tell the truth when asked "why did you ...... (fill in the blanks)".  Do not add any more lies on top of it, just be honest and sincere.

My hubby was denied twice (before we got married) for a tourist visa and when we applied for our CR-1, this question came up on his DS-260 form. He answered yes and under the explanation box, he put the year and the visa type.

Best of luck to you guys...

But we are waiting this visa aproximately 6 years we paid a lot and my mother want to live with her mother this does not mean anything with them?

She lied to them. Doesn't that mean anything to your mom?

Do you do things for people when they lie to you? Aren't you hesitant to trust anything else they say?

I believe it is a mis rep but not necessarily a material fact.  My experience is that this will likely not be an issue for F1. Let us know.

She's not lying now and the case is being processed legally.

Do you feel better moralizing, but not helping? Just a little bit more respect, dear members.

Best regards.

no.

this is not a big comfort group where we put trigger warnings on everything. this is about giving advice on what can happen based on the evidence provided. and in this case a person lied was caught and is now dealing with the consequences of it. worst case is that it was a fatal mistake that will prevent her from ever getting a visa to middle case she will be denied at interview and then need to get a waver to best cade where they don't care and give her the visa. I don't think it will be the best or worse cased but I do think a waver will be needed which will add more time.

Everything is OKAY! today NVC approve our application and waiting interview...

Are you still the OP? (different account?)

Thanks for the update and good luck.

That said, NVC doesn't approve anything for a visa. They only accept and package things together for the embassy so that they can handle your case.

Yes, this is my different account.
Is this the good news or there is still the chance of waiver?

Gotcha.

It just means the case is proceeding. The need for a waiver or not has not been looked at by anybody yet.

Thank you for reply.
One more question: My final action date is 27 August 2011. I'm from Georgia and approximately howlong time need for interview?

Did your mom declare she was denied a visa on the DS260 application at the NVC stage? She will need to be honest about what happened in the past. NVC reviews all the documentation but the decision is made at the interview stage as to whether the visa will be approved.

If the case was just completed it might be several weeks before an interview date is booked. It will depend on how busy the Georgia consulate is.

Final action date was in 2011? Or your Priority Date (PD) was in 2011? Assuming you meant PD, F1 preference from Georgia/Worldwide is currently at 15 March 2011 and progressing at ~7-8 months per year right now. A quick estimate is that it will be current Q3 this year.

Once the PD is current and they can schedule the interview, the limited data available on VJ from other Georgia members looks like they are scheduling interviews in about 2 months or so.
