My wife and me are no longer together

I am so worried about my situation and I need someone to guide me on what to do next, my wife and I are no longer together and my interview for adjustment of status is in 3 days... we both agree that it was fine and that she was going to continue helping me with the process because we ended in good terms, she now had a baby and the new boyfriend is telling her not to go to the interview. I met someone as well, and has offered me to marry me, we are in love and so on...

 

what should I do? I have a lawyer working on the case but I haven't been completely honest about it because I don't know what her reaction will be, things just started getting weird yesterday. I will appreciate all the help possible on what to do.  Thanks

Sounds like a messy situation honestly. 

 

You came in on K-1, B2 visa? Wouldn't be AOS'ing if came in on CR-1.

 

Firstly always be honest. Secondly, this 'rapid' change in relationship status' doesn't look good to any USCIS personnel.

12/14/2017 - Green Card Received in mail - No Interview

Well of you came on k1 you can only adjust status through your petitioner.if you marry someone else you will not get a green card through them. Which means you will have to leave the country.  If you're no longer together I'm sure you're no longer eligible for aos. And you have to tell the truth on your inventory. Changing partner that fast won't help you either.

Honestly, being upfront here... Marriage while on a B2, then AOS'ing but already separated from your I assume still current wife(not officially divorced yet) and already willing to marry someone else? This is all information USCIS will get from you and see and it doesn't look good. Even if your current wife continued your process and then divorced immediately they could come back after you both later for fraud.

If you had came on a K1 and your marriage didn't work out is one thing. But AOS from a B2 and as soon as the paperwork is sent in you both are in other relationships. It reeks of fraud.

 

Not saying it is fraud. But it is a text book example.

 

Is the baby the new boyfriend's? I would say prepare to be scrutinized like crazy.

ALWAYS be 100% honest! If you are no longer together you have to tell them. Lying is misrepresentation, fraud, and will only lead to denial. Don't think for one moment immigration won't find out that you're lying in order to obtain immigration benefits.

Sounds like visa shopping...not good. If I were the USCIS Officer, I would deny. Marrying on a B2 IF it was not planned is fine, but then AOS with a 'seperated' spouse is suspicious. THEN meeting someone else to marry while being married to the first spouse? Red flags...

I would be honest and let the Officer decide

Red Flags all over the place. You're going to have to be 100% honest at the interview or risk a misrepresentation. However, I'm going to guess you have very little chance of AOS at this point given the story you have told us. Like I said, red flags all over the place. Please note that in a previous post someone told you you can't AOS from a new marriage, it has to be the person you married on the K-1 with.
