What are the chances of getting a tourist visa in these kind of situation.. my bf need to go in US as an immigrant and i was pregnant at that time (2008) until now he's still not a USC (2017) and not allowed to go in any country because he cannot enter US again if he does.. our son is now 7yrs old and wanted to see his father.. the only way is that me and my son to go there so they can meet.. i got denied multiple times, last was 2012 bec of the said lack of ties.. i now have a property (we are the owner) and bank accounts, been to other countries with my son, my mom and sister have a multiple us visa, i obtained a us visa under j1 twice before also , but got denied multiple times.. the question is.. if we apply (me and my son) a tourist visa, should i tell that we are going to visit his father? Or to visit my relatives together with my mother and sister like we always do when traveling?

Always tell the truth. It's against the law to lie to a border officer

BF has criminal history and may not get back into the US?

Something about his story doesn't add up.

To the OP, did he lose his immigration status somehow after entering the US? If he is still a green card holder you are not being told the entire truth.

The story your bf is giving you about not being able to travel sounds a little fishy. Green card holders come and go all the time.

He's not yet a greencard holder.. he was petitioned

In that case he would not be in the US, where is he?

Petition is still on process..

So you are saying he either entered the US on a tourist visa and overstayed, so is out of status now...... or, he is misleading you and he does have a GC..

How is he not a green card holder "yet" but was petitioned? Was it a k1?

ETA: I just read the other post after I replied. So he overstayed a visitor visa and is now trying to adjust status?
