No one is accusing you of a fake relationship or a scam.  You're coming as a desperate man who wants to be in the US with his wife and child.  There is nothing wrong with that.  Just trying to help you by pointing out the flaw in your plan to circumvent the K-1 process.  You may not consider it that, but the US Government does.

That's  not  the  plan  I was  just asking  if  that  was  a  possibility we want  to  do this the  right  way  so there  is  nothing  that  can  go  wrong  to  mess  this  up  for  us  and  our  son

When were you last in the US? Have you ever been denied a visa or denied entry or deported? Do you have a current visitor visa or are you eligible for the VWP?

 

If you are legally able to visit the US today then you will still be legally able to enter the US from Canada after getting married. It just depends on if the official at the border is satisfied that you are only entering on a temporary visit.

 

Marrying will invalidate your current K-1 process. Which may not matter if it has indeed gotten lost in the system. Ask your fiancee for a copy of all information she has received from USCIS. If you have a receipt number you can contact immigration yourself to double-check on your case's current status.

 

After marrying you will have to file for a CR-1 visa in order to immigrate to the US.

K1 process going on for 2 years is... rare. Are you sure you didn't receive any rfe? Are you sure you weren't already denied maybe? Are you checking your status at All? Going to Canada to get married will solve nothing. It will void the k1 process and your spouse will have to apply for the spouse visa. Takes about a year to process.

This is very strange. OP, do you have a case number beginning with the letters LDN? If so, you need to make the next move. You need to book the medical appointment and the visa appointment. They won't get done for you. 

 

You up can get married in Canada or wherever you want. It's a free world. But if you're already in the K-1 process you will lose your chance at that visa if you get married and have to start all over again with a spousal visa, which will take another year. That will defeat the object in your case.

A Canadian tourist visa will not allow you entry into the US. If you have F-1 visa from Canada, you you might be able to enter but since your name is already in the system. CBP will decide whether to let you enter.

Looks like you are looking for a way to sneak into the USA through Canada since your K-1 is delaying.

Ask the Canadians in this forum. They don't get free pass and vice versa. Wait until your case is ready.

To be perfectly clear:

You are waiting on a K-1 Fiance Visa. It's taken a ridiculously long time, and no one knows why

  1. You want to get married in Canada
    1. If your K-1 visa were suddenly approved, you would not be able to get married in Canada... you'd have to go to the US and get married within 90 days.
    2. If your K-1 visa is not approved and you get married (anywhere), you are no longer a fiance and no longer qualify for the K-1 visa.
  2. If you do get married in Canada, (thus disqualifying yourself for the K-1 Visa)
    1. You have to return to the UK since you have no US Visa
    2. You need to start all over with the visa process, this time filing an I-130 form
    3. Now, the visa you're applying for is the CR1/IR1 visa for the spouse of a US Citizen
    4. This visa should take about a year to be approved. 
    5. If there's some real reason why your K-1 visa was processing for so long, your CR1 visa might be the same.
  3. We, who are trying to help you, are a bit stymied, because you haven't given us enough information to even hazard a guess as to why your K-1 Visa is taking so long.If you stay calm and give us a list of:
    1. What you originally sent in your package, (as specific as you can be)
    2. Any mail you've received from USCIS
    3. When you have contacted them, what you asked and what they responded, we might be able to help you better.
