My wife entered the USA on K1 Visa, and we were married within 90 days.  

We're ready to file for AOS, EAD and Advance Parole.

She wishes to follow the Filipino tradition of taking her husband's surname, dropping her middle name, and using her maiden surname as her new middle name. So if my last name were Smith, Rosalin Sanchez Reyes becomes Rosalin Reyes Smith. 

 

It appears that she can legally begin to use my last name as her new last name due to proof of marriage, (marriage certificate).  And she should complete all forms (I-485, I-765, I-131, G-325A) using my last name as her last name.

 

But is it possible to drop her middle name while single, and assume her former last name as a middle name?  

And how does one proceed?  

Does she just fill out the AOS and above referenced forms with the new middle and last names?

It seems to me that there are mixed opinions in Visa Journey about this..

I am in a similar situation and I decided to file AOS with how I want my new name to be, meaning I kept my first name, added a new middle name (my original last name) and my husband's last name as my new last name. So far I have only received the NOA1, so I do not know if this would be a problem, but hopefully it will work out!

04/29/19 - Application arrived at USCIS (TX P.O. Box)

05/06/19 - Received NOA1 and extension letter in the mail (dated as received on 04/30 and emitted on 05/03)

07/12/19 - Changed Address with USCIS (IN to CA)

10/16/19 - Biometrics Appointment

03/09/20 - Case Transferred to NBC

03/25/20 - Case ready to be scheduled for interview

03/15/21 - Infopass Appointmet to get I-551 stamp

07/16/21 - Combo interview (N400 + I751)

Wife did the same thing when she applied for AOS.  Her green card came with her new name.

So to be clear, your wife took her former last name as a middle name, and dropped her middle name from birth?

 

Can I hear from other recent Filipino middle name changers.  How did you do it?  By just making your changes on all the AOS related documents?

The rules on name change after marriage are different for each state.  In my state, you can pick any last name (not just your spouse's), however you cannot change your middle name just by getting married (you would need a legal name change to modify your middle name).  Look up the rules for the state you live in.

I was able to have my name changed three months after the wedding.. waited for the PSA issued marriage certificate before legally changed my name...

Your profile indicate IR1/CR1; did you get married in the Philippines?  Then, that country rules would apply...

we did the same thing...and got a new social security card with Noom's new name right after we were married. So far we haven't encountered any problems or issues.

I did the same thing, it has to be on your marriage license and certificate though. It hasn't been a problem, just include a copy of the marriage certificate with each USCIS form!

Hi, I just wanna share about my experienced about that middle name. When me and my husband got married we went right away to social security office to change my name to married name for my Social Security Card however I was shocked for the very first time when SSI told me I can't  just put my maiden name as my Middle name once I get married and have my husband's last name, so middle name stays the same. In other words I never changed my middle name although that's our tradition in the Philippines. I still keep my middle name then my husbands last name as my New last name. I just basically followed what they're rule is here in US unless you legally change your name. But you have an option to put a hyphen on your last name before you get married then your husbands last name. By the way mine I drop my Old last night, keep my middle name then married name. But right now I got a paper from USCIS they also put my maiden name before my married name it makes me confused. All my credit cards and bank card is same as my social security card, school papers/certificates except for my driving permit coz they follow my USCIS papers.
