For CR-1, generally takes about 10-14 months I would say.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Mr. Kastrs. I will be filing for her IR-1 because we've been married for 10years . And she will be flying back here to where I'm at this week, I also consult a lawyer and he said our case is unique . This is the lawyer told me to file. So tell me ...Does my lawyer was wrong in telling me to file IR-1? because I thought AOS is applicable only if my wife is still in US. Since I cannot do that route because I am working overseas, so I will make her come where I'm at. and I will just provide a document to prove to them my intent to go back and stay in the US.

If you are physically in the US, as in maintaining US domicile, she does not need to travel to wherever you work. She could file AOS since both you and her are currently in the US. And she should cease employment until authorized. 

 

Not every lawyer is cut and dry.. they look out for what earns them the most; take advice with a grain of salt.

We started the process for my husband's IR-1 March 2016. Received approval for our i-130 in August 2016 (so approximately 5 months). We delayed submitting the AOS and DS-260 until January 2017 and are still waiting for our CC now (so another say 3 months). After this we wait for our appointment letter from the embassy in Stockholm, have to complete the medical and interview, then tack on a few weeks for my husband's passport to be returned by the embassy. All in I would estimate 10 - 12 months if you went through the process without breaks. Ours is a pretty straightforward case though (famous last words)...

I'm sorry , i am new here and I really don't know if i have to stay on the previous thread since I'm changing route from AOS ,I-130 to IR-1. I apologize .

If you are working overseas, that is normally your primary residence. Can you clarify? (From other thread)

Actually, she is in the US right now under B2 and I am working overseas, I could not be able to file AOS for her , so the solution I made is make her come back here then I will file IR-1 and submit to USCIS.

@Richardrichfield, it is just there was a bit of confusion between the situation in your last post a the change in your decision posted in this post. @Kastrs was simply going by the information you told us in your last post that your wife is inside the US and you wanted to know how to change her status. Now that the decision is made where she will return to you during the immigration process, yes, it will be an IR visa that you will be filing for.
