We were quoted six weeks of waiting. That turned into over 12 weeks for us. We have now been told to wait another 12 weeks for them to review our checklist.

I think it's like that from the start. I just sent mine off a week ago and I have it that way also and I'm sure I'm not anywhere near my CC.

Good luck! Hopefully yours comes soon!

If they haven't sent you a checklist with an specific item missing, it's just the automated message they send when they receive your documents.

They said we were missing some documents and that the signature was not dated. Our attorney filed everything so it seemed odd to me that they would have made a mistake like that. I contacted my attorney and they confirmed that everything had been filed correctly. So I called NVC again to see what the heck had happened.

I was told that the representative I previously spoke with submitted a request for "supervisor review" of our documents (would have been nice if he would have told me that he was going to do that!!!). The person I spoke with this time said that perhaps the person who reviewed our documents the first time made an error, so a supervisor is now going to have a closer look at it. This sounds like National Visa Center made a mistake. It amazes me how they could have made that kind of an error, but I am relieved they have identified that it is likely they made a mistake. I have seen that checklists with EP are handled quickly, I am just worried that supervisor review could slow us down. The person on the phone said it could take up to 6 weeks, but that less complicated errors are often handled sooner than that.

I am calling again to request to speak with a supervisor who can review this now because this is their mistake and I should not be forced to wait longer because they screwed up.

I thought you might find some of the Questions and Answers in the latest NVC Q&A with American Immigration Lawyers Association (November 2016) rather interesting : https://travel.state.gov/content/dam/visas/AILA/Q&A AILA NVC November 2016.pdf

Seems like many lawyers are experiencing delays due to NVC issuing invalid checklists.  Honestly, I sometimes wonder if the NVC is misplacing them intentionally to extend that 11 week review deadline.

And I quote:

Quote

Document Checklists.

Attorneys report that they continue to receive checklists from NVC asking for documents that have already been submitted. Should attorneys resend the same documents to NVC? Or should they send an email to NVCAttorney@state.gov to request clarification?

RESPONSE: When NVC sends a checklist letter for a document already submitted, please respond to NVC’s concerns by providing a written explanation to the NVCAttorney@state.gov mailbox. NVC will re-review the case file in an attempt to locate the document and update the case record accordingly. If attorneys or applicants receive a checklist letter after an appointment has been made and the case has gone to post, applicants should make sure to bring copies of the items requested in the latest or final checklist letter.

False vs. Real Checklists

If you sent the packages, then get a checklist asking for one of the packages, just ignore it; it's a false checklist. Please understand that as soon as NVC reviews a package, they very frequently generate a checklist for the other package, without even checking if they have it in the building first.

The only time a checklist is real (and not false) is if it asks for something very specific missing in a package (like a police certificate, for example). If it asks for something general, like the entire package, then you can assume it's false. Call up an operator at NVC to confirm either way.

Read this wiki... Step 9, specifically.

Good luck! :)

Officially changed to 11 weeks two or three Mondays ago:

https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Submit_documents.html

Quote

Please allow up to 11 weeks for NVC to review your forms and documents once we receive both the financial documents from the petitioner and the applicant’s civil documents. You must also have paid all required fees and submitted a DS-260 Immigrant Visa and Alien Registration Application online at ceac.state.gov. We will not review your file until we have received all of the above requested items. At that time, we will let you know if there are additional items required or if visa pre-processing is complete.

Check our nvc.state.gov/status page to ensure you've taken all the steps necessary for NVC to review your case.
