Hello, 

Im not sure if Im the right forum, Im sorry if I'm not. Im going to the US soon. I just want to ask if it's okay for me to work or study  while I'm on a k1 visa. Of course I will marry my fiance within 90 days of my arrival in the US. I just don't feel like sitting around and wait for him to come back from work. I would like to do something, legal of course. Do you think it will be suspicious or anything when I apply for my green card?

Unfortunately the K1 visa wasn't the right choice if that is going to be a major problem. If you would have went the spousal visa route you could work from the first day you enter the US. Now you have to wait until you have work authorization which is taking 3 - 4 months. Also, in some cases you can't even obtain a drivers license until you have an EAD.

 

So after you marry you, file for adjustment of status (AOS). Along with the AOS, you file for authorization to work (EAD) and authorization to travel outside the US (AP).

 

Fortunately, you can study and attend classes. Do you have a hobby, like photography? Maybe you can take a photograph class and meet new people. Things like that are definitely doable.

Well, you are not the first one who has to wait 3 or 4 months. I have to wait until June or July until I get my EAD.

Sure it's not the best way to sit at the house or apartment but it's what you can do. I sometimes take Uber and go to a Starbucks or to the mall.

 

ROC Timeline

08/16/19: sent I-751 packet to USCIS Lockbox in Dallas

08/19/19: packet received by USCIS

08/21/19: received text message with case number ( Texas Service Center)

08/23/19: check got chashed

08/26/19: received extension letter in the mail

11/14/19: Biometrics appointment

04/28/20: case got transferred to my local field office in Atlanta

05/28/20: New Card Is Being Produced

05/29/20: New Card Got Approved

06/02/20: We Mailed Your New Card

06/03/20: The Post Office Picked Up Your New Card

06/04/20: Card Was Delivered To Me By The Post Office

First of all thank you for your replies. I know I have to wait till I get a job. I am a nail technician, I have my Greek Certificate but I would like to take classes in US too since I want to see how they work there. So I have to wait for that as well? Do i apply for an application if I wanna study? Im sorry I'm a little lost right now. :huh:

I agree with the above. Working is not permitted until you obtain an EAD or green card.

 

Studying and hobbies and such are fine. Just don't go turning them into self employment. :)

 

If you really want to just get out, you can volunteer at a soup kitchen or something. That doesn't qualify as work (you aren't displacing another worker).

We have a similar AOS timeline and I know exactly how you feel!!

 

Our neighbors have been very good to us and offered to help with taking me to the grocery store. I've done lots of cooking too 😂😂😂

I am in the process of AOS now. As I have the same question as you, I have checked so many information online. Unfortunately, there is not much information mentioning can K visa go to school?   I recently found the answer from ICE that wrote  '' Nonimmigrants: who can study ? ''.

And it shows k visa principle may attend school.  

The information was written in 2018 but this information is from the government. I think it is good news for applicants 😃

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
