Hi,

 

My fiance and I just got married under her K1 visa in San Francisco last week and now I want to apply for her I-485 Adjustment of Status using the steps here - http://www.visajourney.com/content/k1k3aos.

 

Here are some questions I have:

  1. Who's name goes on the cover page? I remember for the I-129F sample it was the petitioner's, but since there is no sample cover for AOS, I'm not sure which name should be on it.
  2. Do I need to fill out the G-325a as well, or is it only the beneficiary?
  3. Since she has already done her body check and vaccinations at the embassy in China in December 2016, what does she need to do for the I-693? Does she still need to fill out the form? Or just include copies of the paperwork from December?
  4. In addition to the AOS, she would also like to apply for the I-765 and I-131 in the same package.  Should we treat these as separate envelopes, each with their own documents?  So for example, would she need to make three copies of her passport (one for each: I-485, I-765, I-131) or just one copy is enough for all of them since they're all in the same package?
  5. For the I-864, what supporting documents do I need to include besides my 2016 tax return?

1 and 2: It's only the foreigner who adjust status, this isn't the US citizen's application for obvious reasons. The only part that the US citizen is involved in is the i-864.

 

3. Just send a copy of the DS-3025 (vaccination work sheet that she got at the medical) if marked "complete".

 

4: i-765 and i-131 are separare applications but you send them together with the i-485 package, just separate them with a paper clip. You need two passport photos for each application, copies of passport, visa, entry stamps, i-94 and so on. Some say it's not necessary but rather do too much than too little to be on the safe side. When I got married I had a name change so I sent a copy of my marriage certificate with each application as well, as proof of name change.

 

5: Depends on your employment situation. If you're self-employed or not. If not self employed you usually send W2, tax transcript, pay stubs and letter from employer.

Is one year of taxes enough?  Or should I include from more years, like 2013, 2014, 2015?

 

Also, how many paystubs?

I agree with @Scandi 

I only sent one copy of the evidence that was required by more than one application (as noted in the instructions). I divided things very clearly so all supporting documentation for i-485, i-765 and i-131 was in one bundle and supporting documents for the i-864 in one bundle. I had no problems.

However, I have seen ppl rfe'd many times for not including suporting evidence that actually was included. Probably it got separated in processing without being copied. For that reason, had I done it over again I'd definitely go with better safe than sorry when it comes to including a couple of extra copies..

We just completed the  I-485 Adjustment of Status process. Even though your wife was seen by a doctor and was vaccinated in China, she might have to repeat the process when she is seen by a US civil Surgeon. You have to also make sure you download the new Form I-485. My wife tested positive on her TB test because the Chinese government gives all new born children a vaccine that causes a positive result when the USA test is administered. Anyway, she had to have an x-ray and be evaluated by a health department doctor. If at all possible, if you have health insurance, have your primary doctor take care of most of the medical stuff before seeing a civil surgeon. It is very costly to have the civil surgeon do all that is listed on Form  I-693.

I formatted mine like this:

APPLICATION TYPE (Adjustment of status/Employment authorization document/advance parole)

Applicant name: the one applying for AOS (Alien number)

Petitioner: your name

Everything can be named after the applicant. Only the i864 would need the petitioner's details and signature.

Include a copy of the ds3025 in the AOS application. The ds3025 is valid for a year if i am not mistaken. They might require the i693 at your interview.

Treat all of the forms as a separate package. They will be processed differently. Make separate copies of each requirements for the different forms. Have a cover letter for each form (i485, i765, i131). Have a main cover letter for the whole package indicating that you are applying for aos and concurrently applying for i765 and i131--including a check for the aos application fee and biometrics fee. I765 and i131 are free if filed together with the i485.

We included tax transcripts for 2016, 2015, and 2014. Pay stubs for the past 6 months and a bank deposit summary for the recent year.
