Thanks! K-1 is faster right? and i can travel to US to visit her while i'm in the process?

having visa speed up the process or is still normal?

Depends on your situation..

K1 - you will most likely be able to enter faster into the US but will then have to Adjust Status which can take time. Expect to not be working for at least 3 months until you have employment authorisation (no income).

CR1 - might take longer but once in you will receive your GC right away and go to work (in the meantime still earning a wage in your home country until the process is finalised)

Very broad reasons above!

It is typically faster yes. No specifics on time lines but say 6-7 months maybe? The peititoning portion until visa issuance. No guarantees though could be more.

And yes you can still visit her while the petition is processing. You just have to continue to show strong ties to your home country like you do now when ever you go to the US. And always tell them the truth(immigrations that is) on your purpose of visiting.

So the CR1 is more convenient because i can work right away. K1 process is 6-8 months and CR1? i don't understand the "processing times" in this forum so if you know about CR1 process time let me know please.

Comes down to what you want to prioritize..

K1 gets you here faster, you two are together, but has more filing fees once in the US, so more expensive overall. 4-6 mos; still have to apply for GC.

CR-1 takes longer, you two are apart longer, but get permanent residency the moment you enter and is overall cheaper. 10-12 mos; overall cheaper.

Or to simplify, K1 faster but CR1 less fees.

The thing is I want to marry my girlfriend this December but she doesn't know anything I know I can't go to the US with the intention to stay or with anything that they seems like I want to stay (rings, paperwork, etc.) I know that. Everything that I'd do like buying a ring and its there's going to be when I arrive in the US. But I have a question, if I get married with her and I stay for 2 to 3 moths there I can go for an AOS?

your plan is fraud even if your girlfriend does not know anything about it. it also seems like you are trying to force her hand by suprising her with marriage and then wanting to adjust status.

I would recommend filing for a k1 vIsa since they are faster and there is nothing to stop you from visiting while it is pending since you already have the visa.

rwe already answered your question. NO you cannot come here on a b/2 marry and adjust status. You have stated you have intent to do so, that is visa fraud. Period.

Oh boy !

you are running too fast. Please make sure she wants to marry you and later maybe she wants to file a petition for you

Wish you the best

LoL, finally some sense in this thread. Some are so eager to scream fraud on this forum.

OP dude, you have bigger fish to fry. If she agrees to marry you then agrees to sponsor you then you can read the guides on this site.

Good luck
