Pregnant, husband wants a divorce...

Hello!

I'm a conditional green card holder, I just got it in July. We got married in January and it hasn't been an easy year for us, we've had our fair share of fights, some more serious then the others... On Friday we found out that I'm pregnant. Financially it will not be a good thing, we would have to struggle to support a child. Still I just can't get an abortion. There are so many people who struggle and still make it. Anyhow, me and my husband had an argument about it that led to him saying he wants a divorce. I don't have an insurance. I might be able to get one through my job but not until February. Can I get some kind of governmental insurance or subsidies until then? I just won't be able to afford everything with my salary and i don't know where to turn for help.

You have to be more clear... This is a very technical matter so the exact answers will determine the answers.

Why do you NOT have any insurance presently? Are you aware the law requires you to have insurance or pay a penalty? Does your husband work? Does he have an insurance plan available to him through his job? Does he have insurance for himself on it? When he said "he wants a divorce"- what does that mean? Is he going to file paperwork? Has he? Has he moved out? Or are you just looking to see what could potentially happen if or when he does? (please answer all the questions if you can)

We need more info. If your husband has insurance through his job, usually he can add you to his insurance. If he has not, and you have NO insurance, he's now violating the law.

First, if you are not abused, you don't have to leave the house

IF there is abuse call 911 and ask for protective housing

He will be surprised to find out you are eligible for financial support from him (alimony and child support)

and don't worry about his bills

he should have bought your health insurance (from Obama care) when you came or added you to his insurance once he married so you can convert it to cobra

hope he is not saying it is not his baby / if that is the case there is free DNA tests thru a TV program you may see on TV / don't think i can mention the name here

First off, I understanding not having insurance. Requirement is a loose term for this, you are breaking the law in a way, but your punishment is a fine that comes out of your tax return, if you recieve no money back then it's a fine you pay back. No one's going to arrest you or anything fun like that, it's not -that- big of a deal if you're willing to pay the fine.

For some households it's better to eat the cost. Even with the "subsidy" they would have given us, it was the choice between never saving money to put into the savings account or having insurance. We'd rather eat the fine out of our tax return at the end of the year and be able to have money in savings, than pay 400+$ a month for insurance we aren't using. (On average, we see a doctor once a year or less). I should be elligble for insurance through my company in Feburary, so we'll have coverage then, but yeah, no intentions of having it until then.


But it says you're in Texas, I would recommend looking into the CHIP perinatal coverage: It's for women who are pregnant, can not recieve medicaid, and have no other form of health coverage. It's not Medicaid, it's through the state, but I'm not 100% sure how it plays on means based things as it does have an income limit, but it doesn't use tax money or anything like that to pay for. https://yourtexasbenefits.hhsc.texas.gov/programs/health/women/chip-perinatal



Also, your husband may have a bad time. In Texas, you can initiate the divorce, but you CAN'T finalize the divorce until the baby is born because they will want the baby to be included in the divorce decree. Yeah the income cut offs are listed here https://yourtexasbenefits.hhsc.texas.gov/programs/health/women/chip-perinatal , and are well above poverty lines. A family of 2 would have to make less than 32k a year to qualify for this, a family of 3, less than 41k a year.
