my husband wants to file a I-130 form for me and we are struggling with the part that is asking for additional information to show that our marriage is legitimate we have everything else needed for the form but we don't own a property together or a business or have children etc .. I have known him ten years and we have spend a lot of time travelling and communicating in that time I am currently back home in the UK to finish my degree . what can we do about this additional information would this effect the application... Please help :(

Proof that you spent time together- airline tickets, photos, hotel receipts etc.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hi Louise, since you've known him for ten years, I'm sure you'll be able to have enough evidence. Wedding photos are great to include. You can also include Skype chats/screenshots, text messages, mail that you sent to each other, etc.

If your wedding was recent, you can include different evidence from that as well. Anything which had both your names on it, receipts, etc.

Thank you for ur information .. whilst the application is pending is it wise to travel over there as im aware u can be stopped at boarder Control. . Would I need a B2 visa to allow me to do this whilst my application is pending or ca I do this under the Visa waiver programme ?

You can visit under the visa waiver program, but you cannot live in the USA or work; be sure to never overstay your 90 days.

You can use the VWP to visit. I visited twice from the UK during the wait for the I-130 to be approved. Another thing you can do for evidence is have him listed as your emergency contact/next of kin with your employer and then get yourHR department to provide a signed statement to that effect. Also have him as the beneficiary of your workplace pension in case you die before you retire.

Ahhh Okay as I was hoping to go over om June once im done with my degree I would ideally like to complete my postgraduate studies out there if possible but i may visit before then as i am def going i december and my vwp is valid for two years i believe.. so once things get in line with this application hopefully I won't hit any hurdles .. in relation to evidrmce for my application can my husbands parents provide any types of written statements on my behalf as they have also known me many years they are also going to help support my application when it comes to providing affidavits of support

They can but they won't do much good. You have much better evidence from all the time spent together over the last 10 years. For what it's worth, we have been together 4.5 years (it was less than 4 years when we started this process) and we didn't send any affidavits and we were approved with no RFEs.

Affidavits are good for people who struggle with other forms of evidence and cannot spend time together for financial, religious or cultural reasons.

Okay thank you so much for ur help I've just being super stressed about the whole thing ... it makes me sad that when u genuinely want your life with someone u love it has to take all this to get there ... well I'll send what I can with the application and hope for the best .. it is my husband who submits the I-130 application right om my behalf as he is in america and he is a citerzen

That's right. He is petitioning for you. Technically it's not an application but a petition. You will complete an application later when the petition has been approved.

Don't worry about it. The London embassy is one of the most laid-back and easy to deal with.

He sends the petition to the appropriate lockbox address based on his state of residence. Once it's approved you then do your bit at the NVC (application and supporting documents). Then your case is sent to London and you have a medical exam and an interview.

I'm still in the UK waiting for the NVC to finish reviewing my documents and set my interview date. We started this in February this year. All being well, I hope to be with my husband by mid-December.
