EAD timeline 60 days not even biometrics yet

I just really hope in a miracle that the EAD will be approved without the bio and ill just get biometrics after i get the EAD card.

I hope you are right. However I think you are wrong and it does reset the timeline on EAD.

Not true! An RFE puts things on hold and DOES NOT reset any processes.

You used a lawyer and still managed to get an RFE for basic evidence? Usually I advise people to seek counsel or lawyer up. In this case I am recommending you "lawyer down". The fact that you are asking here tells me you already have little confidence in their services (as you should) AND they did not inform you of the process/timeline.

I hope you are right. However I think you are wrong and it does reset the timeline on EAD.

USCIS does not re-start the time, they pick up right where the case left off due to an RFE. Once RFE is received, processing on your case continues, you don't go to the bottom of the pile of petitions.

RFE delays processing of your case, but resumes when RFE is received and satisfied USCIS received of what was requested.

AOS FROM WVP THROUGH MARRIAGE

We have submitted i485 i130 i765 on August 5-th. Received NOA receipt august 19. Since then I got a Request For Initial Evidence on September 16 and response was received by UCIS Oct 3. RFE was for petitioners current income. Did not make too much sense as we submitted a joined sponsor with 70K+ income but they trying to approve my wife without the joined sponsor.

I did not get ant biometrics appointment letter yet.

My question is when should i expect my EAD card

You wont receive it without doing the biometrics, because the biometrics is where they take your fingerprints, photos and signature. This is what they use for the ead and the ap card. The fbi runs their checks with your fingerprints, so it is needed first. I had a similar issue, only I have never been asked for RFE. I waited over a month to contact uscis regarding the fact that i had not yet received my biometrics mail and appointment. I called them and they created a report and told me to wait 45 days. I later then received the bio letter and did a successful walk in a month ago. I have not heard anything yet.

I always say... expect what their process guidelines say but HOPE for the best outcome.

Well I contacted USCIS yesterday to inquire if I would receive my card soon.. I spoke to S55290 and she told me that it usually takes 90 days but the bio would cause it to be delayed so I can expect it anytime from about 45 days after the 90th day. So if it would delay mine since mine took 50 days, then I can only assume it would be the same for someone who has not received the bio as yet.

In addition to what I said previously... the biometrics is where they take your photo, signature and fingerprint.. all of which is printed on the EAD/AP Card. So how can you get an EAD card without those?

You can do a search in VJ people have gotten their EAD without bio I'm not saying it happen all the time just that it can happen.

They are probably referring to the renewal of the EAD. Even on the NOA 1 receipts it tells you the next step is biometrics... for first time filers that is. When we have to reapply in a year 120 days before it expires, they wont expect you to pay for biometrics or do biometrics again because they would assume you look the same, that your fingerprint doesnt change and you signature is the same. Mine took long and I did a successful walk in on the 14th of September, 50 days after I filed.

What are biometrics?

In scientific terms, “biometrics “ means anatomical or physiological data by which a person can be uniquely identified. At your biometrics appointment, USCIS will most likely collect your fingerprints, take your photo, and have you sign your name for electronic capture.

Failure to attend your biometric services appointment may result in denial of your application.

Applicants under the age of 14 and over the age of 79 are not required to be fingerprinted. However, they may still be required to attend a biometrics appointment in order to have their photograph and signature captured.

At the end of the biometrics appointment, you will be given a stamp on your appointment notice confirming that you attended. Keep this document safe, in case you are later asked for it or USCIS cannot find its record stating that you indeed came to the appointment.
