 Just wanted to update you all -- I got an RFE :bonk:  although I technically haven't received the checklist yet -- I just found out about it via phone today.
 

As a heads up to everyone with joint sponsors -- I got it because my joint sponsor (my father) filled out an I-864, instead of the I-864A (he lives in my household). I was under the impression from countless other posts on here that if you have a joint sponsor they fill out the I-864 even if they are in your household, unless you are married (filing jointly) or if one is claimed a dependent (as far as taxes are concerned). Neither of those applies to my case. But here I am. RFE! Grrr....

 

So now I'm just waiting for them to send the checklist because I don't want to miss something and get a second checklist.

OH NO!!!!!!! I'm probably going to get it too, then. No frikken way!!!! And I'm only in for 3 weeks right now since the scan date. I have a joint sponsor (mom) and i moved back in with my mom last September. She never claimed me in her tax so i did the 864 as well. I can't. I just can't.

09/24 - Sent out I-130 to Phoenix, AZ

09/26 - Received at Phoenix (somewhere in between, the I-797 was mailed and marked back to sender due to post office error)

10/24 - Finally got the I-797 NOA-1 resent to me - forwarded my case to NSC

11/04 - Status changed to RFE

Thank you misshepburn for sharing the information so others don't make the same mistake.  I did read in a few posts that an I-864 can be used instead of I-864A for co-sponsor.  Looks like that wasn't accurate.

Good luck with the RFE.  For the USCIS, we learned that RFE means the case is close to be approved. I hope it's the same at NVC

Hi,

Just a clarification, I-864 is for the sponsor and joint sponsor that is not a member of the household but we should use I-864A if the sponsor is a member of the household?

Thanks, onek!!! I have to say the electronic processing (EP) is super fast. They reviewed what I sent and then sent the RFE 8 days later. Based on other EP filers - (and assuming after this I don't get another RFE) we should get a case complete in a few days.

StellaMaries -- Yes, that is correct.

 

I was under the impression (mostly from posts on this site) that if you lived with your joint sponsor (in my case its my father and mother) you could do an I-864 for the joint sponsor (in my case my father) and the I-864A for the joint sponsor's spouse (in my case my mother). The way I interpreted it was that since they don't claim me as a dependent on taxes, we are not in the same "household" as far as the IRS is concerned - and the I-864 would be ok. 

 

Unfortunately this triggered an RFE in my case. I'm not sure if it was just the person looking at my file or if this is indeed the more "correct" way to file the forms. My suggestion is to do it this way if you and your joint sponsor are related and live in the same house. Below I pasted the instructions from the USCIS website for the I-864A -- it does say that if you live at the same principal address - that you are "household" members and to fill out the I-864A. 

 

ALSO -- I was asked for W-2's for myself (just for 2015 tax year) even though I submitted my tax transcripts for all 3 years. I was perplexed by this because the USCIS site says you only need to submit W2's if you cannot obtain a tax transcript. Just wanted to pass this on for those "on the fence" and unsure of whether you should submit more docs or not!! Lesson learned: Send in the W2s anyways!

 

From USCIS:

"Form I-864A may only be used when a sponsor’s income and assets do not meet the income requirements of Form I-864 and the qualifying household member chooses to combine his or her resources with the income and/or assets of a sponsor to meet the requirements. The obligations of the household member under this contract terminate when the obligations of the sponsor under the Af davit of Support terminate.

For additional information, see section 213A of the Immigration and Nationality Act (INA), and part 213a of Title 8 of the Code of Federal Regulations.

What Is a Sponsor?

A sponsor is:

  1. The petitioning relative;

  2. A relative with a signi cant ownership interest in the petitioning entity; or

  3. A substitute in the case of a deceased petitioner, or another person accepting joint and several liability with the sponsor;

    AND

  4. Someone who completes and les Form I-864 on behalf of an intending immigrant. A sponsor must be an individual

    and may not be an enterprise, a business, or any other type of organization.

Who May Be Considered a Household Member for Purposes of Form I-864A?

For purposes of this contract, a household member is:

  1. A U.S. citizen, lawful permanent resident, or U.S. national relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

  2. A U.S. citizen, lawful permanent resident, or U.S. national relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor’s most recent Federal income tax return even if that person does not live at the same residence as the sponsor; or

  3. The intending immigrant, in certain circumstances. (See the How Can the Intending Immigrant Be Considered a Household Member section of these Instructions.) "

To update, today marks 6 weeks at the NVC from the AOS being recieved, still nothing heard from them.  I called them monday and they stated I would hear from them today.... BLEHH

If you don't mind a follow up question regarding tax transcript.

My husband is my principal sponsor and currently in the US.

He can't submit itr for 2014 and 2015 for a reason he was out of US with me. I know we need to write an explanation letter.

Regarding w2 and 1040, he recently filed itr. Is it really necessary to submit tax transcript from IRS? And SSA earning statement?

Being out of the country is NOT a valid excuse for not filing your taxes. The US is one of the few countries which requires its citizens to file taxes when living abroad. Was your husband unemployed during that time? Not having any income is the only reason you typically would not file taxes. If he did have a job in the Philippines he'll need to quickly file his tax returns retroactively.

You can submit either tax return transcripts OR W2+1040. Either option is okay.

Hi StellaMaries -- you are welcome! 

 

So agripa is right -- as a US citizen (even a dual citizen) you MUST file taxes with the US government annually. Even if you've been overseas for years and pay another country taxes, you still have to file with the IRS. Beyond that I will leave it up to others for advice, because I'm not an accountant and don't have much experience with international tax law. 

 

For NVC the rules are pretty clear - they say they prefer a tax transcript to the 1040 + W2 combination, but either is allowed. You also do not have to submit documents from all 3 years - if your husband has been in a stable job with the same firm and earns enough money, one year (the most recent) is usually sufficient. That being said, they could still ask for all 3 years of tax forms in a checklist - so if providing these documents might be a problem - you should make arrangements now as Agripa suggested. As far as I know social security statements are not required.
