k1 denied under 221(g) - no relationship with you and petitioner, advise please!

EDIT: I misread, and I see you did meet once.

If you get denied, meet again. Its generally a good idea for relationships. Meet your partner. You can meet in a 3rd country if she doesn't want to go to Venezuela.

Hi guys, me and fiance has known each other for 3 and half years and we finally been together when he decided to fly for a week down here in malaysia on last october. We filed the petition on last December, got called for an interview yesterday at the american embassy in kuala lumpur.

I was asked few questions on how i met my fiance (which i told them the truth that we known each other online) and when they asked me when did he asked me to marry him, i told them before he even met me and he actually sent me the ring first before he even meet me in person. i remember the CO asked me that if i am sure that a week together is just enough for me to be married to him and i said yes because i known that man for 3 and half years and he's been taking care of me and my daughter ever since then. The next question was asked that is it true that my fiance was married twice i said yes and the divorce took place quite a while ago. and right after that is when i was given the white paper stating that i was denied under such reason that i dont have a relationship with him and it will be return to USCIS

what devastated me the most is that i was only that few questions and i wasnt even asked to present for any proof or evidence of relationship like the pictures that we have together and others.

Please help us, me and my daughter are so brokenhearted as he has been in our lives for a while and he has been nothing but loving and providing to both of us ever since then :cry:

Could be you answered something wrong she asked you such as his divorce was quite a long while ago........... Not implying your fiancé is lying to you, but did you see his divorce papers and date the Final Decree was signed off my Judge?

Was there pics of you and him and your family? Such as parents, brothers, sisters, an engagement party-celebration when he was there?

You met the requirement's of filing a K1 visa, so I would say there is a reason why the CO said you don't have a relationship with Petitioner.

You could cancel the K1, marry and file a CR1, BUT that wont do any good until the reason your were denied is corrected.

Spend more time together before you file for a visa again. And don't volunteer information, answer the questions they ask, short, straight to the point answer.

No point in cancelling the K1 as it's been denied and will go back to USCIS and stay there untouched until expired and gone.

There's a small chance of a second interview but it's a very small chance and it has to be done before the application is sent back to the US.

What reason was given to you for not having a relationship with him when your application was denied? You have met the requirement that the petitioner and beneficiary have met in person during the two years immediately preceding the filing of the petition even if only for one week.

What reason was given to you when your application was denied? You have met the requirement that the petitioner and beneficiary have met in person during the two years immediately preceding the filing of the petition even if only for one week. Do you think it's the red flags such as sending you the ring before seeing you, sending money to provide for you, his multiple divorce, etc?

Red flag= time not spent together

red flag- he is divorced 2 times already

red flag - he sends money to you

They have met only once during the years they have been together. He has been divorced 2 times already and it's never a good idea to show proof of money going in any direction.

Im sorry that you got denied but in 5 years I've been here in visa journey I see red flags in your case.

  • Although you met in person, 1 week visit throughout your 3 years relationship seems to little to proof a genuine relationship
  • He sends you money. Not that it's a clear red flag but I've seen in a few cases, proving that the USC petitioner sends money even if is not that much sends a wrong message
  • 11 years between you guys plus 2 fail marriages

Sounds pretty much like someone whose trying to come to the States, just because of the papers. NOT saying by any means this is your case, just trying to think like the CO who denied your application.

I would definitely refill in a year or so or get married and apply for a CR1...the downside of this is that the CR1 takes almost a year but you will a have a better chance specially if he plans to visit you more often.

Definitely increasing the amount of time together is a must if you truly wants to be together.

I'm kinda worried now because I've met my fiancée only once this past February for two weeks and the rest we've been communicating via video chat and messaging for a total of 2 years. And I got divorced 6 years ago.

I am so sorry about that dear, would he consider going back there and getting married there and coming back to America and doing the other visa? That visa would take about a year to get but it will get you two together.... I will pray for you all, can you appeal the decision?

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

You could both get married in Malaysia if possible. Maybe that is the only way out...I think!

I might be wrong but I believe in Malaysia, if a non-muslim were to marry a Muslim, it is obligatory for him/ her to convert to Islam.

Back in 2009 when I was on here under another name, A friend of mine , her fiancé was denied at interview for a K1,

She was told by USCIS, to cancel the K1 first, then she could file a new petition for a CR1 after then married.
