As long as you can prove bona fide marriage (co-habitation & financial co-mingling), you can file your I-751 with a divorce waiver.

Yes, you ROC yourself as soon as you are finally divorced. Just remember you have to still prove the marriage was entered in good faith.

The OP can stay, and file for ROC herself.

I'm not sure why you would wonder why she wants to stay.

Maybe she's made friends, or has a job, or some sort of support group.

Whatever her reason, it makes no difference as long as she can prove she entered the marriage in good faith.

OP, as other have stated, you can indeed stay and remove conditions yourself.

There's a lot involved in moving to another country; selling/giving up your home, your car, your furniture, your job.... Maybe OP doesn't wanna move yet again and set everything up from scratch again. And once she got to America, I'm sure OP set roots here. Eight months is a pretty long time. I mean I've only been here two months and I'm already fully situated with home, car, career, driver's license, friends... The whole nine yards.

OP, you can still ROC on your own. Make sure you have bona fida evidence such as joint bank account statements, things showing you live on the same address, maybe you have credit cards together... If you're planning on moving out and divorcing your husband, I would try and get that before moving as you never know what your husband will do once you file for divorce. We see a fair amount of posts on VJ from angry USC spouses who wants to try and stop their foreign spouse from ROC.
