Hello my name is mamai YAA . Please I have a few questions and i would appricate any respond I can get.

I and my husband got married in Ghana last year October 2015 . And he has his intrview june 6th at the Ghana embassy . However his father just passed away and the family is planing on a funeral first week of August. So he has to stay back and finish all arrangements with the family before coming . Please my question is how long can one stay in Ghana after receiving the visa. Because I read online that after the CR1 visa we would have to change it into the R1 visa before our 2 year anniversary . So please what if he comes ending of September or a few weeks to our 2 year anniversary. Will it jeopardize the time frame that we have into getting the R1.

You would not have to change anything. On his visa there should be an expiry date. If you got married in October 2015, he would have to enter after October 2017 to get an IR1 notation vs a CR1 notation. No matter how you look at it, your husband will have a CR1 visa upon entry and a 2 year green card.

So your saying after his Intreview we should wait till October of this year for him to enter US that way he would recieve the R1 over the CR1?

No he would have to enter the USA in October 2017, next year, to get the 10 year green card instead of the 2 year green card.

There is no R1 visa. It's an IR1 or CR1. Immediate Resident -1 or Conditional Resident - 1. The IR1 leads to the 10 year green card and the CR1 leads to the 2 year green card. No matter what it says on the visa, if your husband enters the USA on or after your 2 year anniversary date, he would get the 10 year green card. If it's before the 2 year anniversary it's a 2 year green card and you have to remove conditions.

If you were married in October 2015, it's impossible for your husband to get the IR1 visa with an interview date of June 6, 2016.

Okay then yes, if your husband enters after your wedding anniversary, he would get the 10 year green card.

Make sure his medical date is as close to his interview as he can.

Do you have to have a Valid police certificate to enter the US on your spousal visa?

As far as I know it only has to be valid to interviewn but it's possible they may request it to valid for afterwards.

You don't have to do any thing, if your husband pass through the process successfully He will be given 6 months visa, before it expires...just prepare for the interview well that is what import. No about things which raise red flag, and stay away from them. Thanks. Googl and read about things which raise red flag

He will have 6 months from the date of his medical not the interview. So when he gets his visa he needs to be very clear of the date it expires. He needs to be in America on or before that date.

Not sure what day of Oct is your anniversary but if his visa gets approved and he has to stay there till August, i suggest him to come to US say a day after your second anniversary at the earliest (to get 10 year GC) if his medical is valid beyond that date. If he does so, you two don't have to go thru the ROC process which itself is a sort of pain. If he comes to US even a day before your second anniversary, he will get the 2 year GC. Waiting for few weeks or a month more is worth now compared to the ROC process later on.
