I have a conditional residence card. My husband and I will be 2 years married on April 28th I have to remove conditions and file for permanent residence 90 days before August 2017. I'm currently 7 months pregnant I love him more than anything he's my one and only friend. I'm thinking bout filing for the divorce. but he does not want to work things out in this marriage anymore and I'm so heartbroken. Before I take the next steps I wanna know what my options are since I'm not even close in removing conditions. What will happen to our kid? Will I able to go back to my country with my kid or will I have a chance to stay here? I'm so confused and I don't wanna leave I worked so hard to start a life here and I don't want my kid away from his dad either I need advises pls

why leave? you can remove conditions on your own as divorced

you have to gather evidence since you married and became a LPR, that your marriage was bona fide

I didn't think that was possible if you were not longer married. Excuse my ignorance, I'm just extremely scared of what's gonna happen to my baby if I decide to file for the divorce, weather I go back to my country or I stay here all I want is to be with my baby. He keeps telling me I can't take the baby to another county without his consent and I will have to go back without him or it'll be like kidnapping.

If you go back to your country before the baby is born he can't stop you. After baby is born you will need the fathers consent or a court order to allow you to take the baby out of the US.

If you want to stay you can, you do not have to leave if you want to stay. You file for ROC with a divorce waiver with proof you entered the marriage in good faith.

I'm currently 7 months pregnant so I don't think going back to my country right now it's an option for me. Besides I don't wanna take the baby away from his dad. My only concern here was having the baby, getting divorced and then USCIS telling me I had to go back to my country bc I don't longer gain residency bc im not longer married and having to leave my child behind or just stay in an illegal status. I don't know just thousands of things going thru my mind. But I guess I can remove conditions on my own. That's a huge thing for me right now. Thank you so much everyone

Why? Please educate the rest of us.

There's nothing in the law that says a pregnant woman can't file for divorce or that being pregnant makes it harder to obtain.

Several states won't grant a divorce while pregnant. File away, but they'll wait to finalize until after the baby is born.

The divorce is usually put on hold until the birth so issues about paternity, custody, and child support can be dealt with.

The OP is 7 months pregnant, so it's not really an issue in her case.

Pregnancy does not make getting a divorce harder. It just prolong issues surrounding the child.
