Hello,

My mother in law is coming to visit us in US soon on a tourist visa. My wife is a green card holder now, but hopefully she will be getting her US citizenship soon. My question is, if my wife gets her citizenship while her mother is in the US on a tourist visa, how would we convert it to a green card for her mother?

Thanks,

Tony

Had your mil been in the country already and you all decided out of the blue that you wanted her to stay then you be fine. But entering with the intent of staying is illegal.

The subject is fraud. Not asking a question

Not sure what your idea of what a question is. I was reading your posts, and apparently you came here on a tourist visa, got pregnant and did adjustment of status to stay. Isn't it fraud on your part?

Nope. I entered on a tourist visa to visit family and friends . I had my birth and everything booked back home. I was t even divorced when I entered so I had no way to adjust. Circumstances changed and I had to be hospitalized. By the time both myself and my child were healthy enough to travel I had overstayed. I'm now in a position to adjust status. Different story.

My point is it's not up to you or anyone to decide if my question is fraud. It's up to uscis to decide. I was just simply asking a question, and I thought that was the purpose of the form. One could still argue what you did was fraud because you knew you were pregnant while applying for tourist visa. Case closed.

No. It's not case closed. What I did cant be argued as fraud because I didn't enter with intent. You're suggesting entering with intent. And as a Canadian we don't apply for tourist visas. We are automatically given one upon entry to the USA. No applying, no fee.
