How often do they usually request an interview for I-751?

I'm a bit nervous and I probably shouldn't be but I was wondering do they usually prefer to have an interview with the couple of do they prefer not to? I don't have an awful lot of evidence to send but I have a few things: health insurance card with names on it, joint tax return transcript, joint bank account, photos, Christmas cards, I can get affidavits... I explained all this in a previous post lol but I just wanted to ask how often do they request an interview?

They usually ask for an interview if there is something unclear or suspicious, sometimes they will send you RFE and then you have to send what they ask for.

If you can, send some of the following;

Joint car title

Joint car insurance

Joint phone bill

Joint utility bills

Living wills, health care power of attorney

Joint stores membership

Joint lease/loan

The immigration process caused me PTSD.

You can send them a letter explaining why you dont have it. If they asked you to come in for interview, you and your spouse should go together. If your spouse does not go with you then there is a chance of 99% your application will get denied.

This document is from 2013. https://www.dhs.gov/sites/default/files/publications/cisomb-conditional-residence-recommendation-final-02282013_1.pdf

covers statistics from 2008 to 2013. Go to page 18. You will see 08&09 they tranfered a lot of cases to interviews. Almost like 1 in 4. Then the rate drops sharply, maybe to 1 in 12. Probably they changed policies so that most of the adjudications takes place at service centers. It is still the case, only a few cases go to interview and usually after at least an RFE. But of all cases rejection rate is around 2%. So no reason to worry if you are in a bona fide marriage. It may just take longer to get approved if your case is not strong.

Don't worry about card of photos - discard these and place to one side.... not needed. Its just fluffy secondary evidence to bulk out a weak application. All they are wanting to see is financial co-mingling from the day you married. There has been some great advice above on what sort of things you can send. And a letter explaining why you don't have certain evidence is fine also. They like to see proof of financial co-mingling from the day you married. Well I never received my SS# until 1 year after we married. So along with every single bank statement I wrote a cover letter explaining that all the bank statements sent start on such and such date because this was the date I received my SS#. I was lucky enough to find a copy of the bank agreement adding me to my husbands bank account with dates and all our signatures including the bank managers LOL!!! so its clear I was added the week I received my SS#, I sent this piece of evidence also. Try to supply as much evidence as azzein recommended.

Actually SOME types of photos can be very helpful and convincing. I'm in a same-sex marriage and during our interview we gave the officer photos with both pur families and some photos of me with my husband's grandmother and great-grandmother. The officer said: "If the grandmas approve then I approve too" and she approved my application right on the spot. The fact that we are close to each other's families convinced the officer that our marriage was real.

So far, USCIS has never had a photograph of my husband and I together as a couple.

Photos are only ever secondary evidence, so don't bother if you have good primary evidence. For RoC, the thing they care about is a) are you living together and b) have you co-mingled your lives in terms of financial assets and responsibilities. So, the tax returns, joint bank accounts (they like to see statements from the whole length of your marriage), co-ownership of homes, cars, insurance etc. are what you need to be sending.

Statistically, you're unlikely to be interviewed, but even if you are - as a genuine couple you have nothing at all to be concerned about - and you can save any photos or softer evidence for such a time. Very few people fail to pass through the RoC stage.

I would say the best kind of photos you can send are with family and friends on holidays, events and occasions. Like on Christmas, Thanksgiving, birthdays, 4th of july,etc..

I dont have a link for this but its been discussed many times. I suppose someone could try to dig around for an old post with the link but I dont have time..

So this may not be exactly word for word- but when the ROC application is received they code is as A B or C. My memory is failing a bit but Im going to say A is for everything is perfect, meets all the standards. B is for acceptable in regards to docs and proof but theres just something about it that causes them to not label it as a slam dunk A. C is for anything with issues.

All C applications go for interviews. A portion of B applications go for interviews (quality control) again my memory is failing but I believe its between 10-30%. For A applications also a portion goes for interviews for quality control but its very few 10% or less.

This information is a bit outdated but I dont think much has changed. As stated its a very low denial rate for ROC. If you are a legitimate couple then you shouldnt really be worried to the point of sleeplessness because if you have deficiencies in evidence you will be interviewed and found to be legit.

  • 3 weeks later...

Officer Boyo today on the phone (a 27 year veteran) told me that every single case goes to interview. I actually had him repeat this to me, and questioned him on it twice because from Visajourney, I know that a larger number of applicants don't. But you have it from an expert 27 year veteran of USCIS named Officer Boyo that everyone gets one for ROC.

So yeah... take any information you get from these guys as truth or not.

Photos are definitely secondary evidence. They're primarily looking for financial co-mingling.

That being said, I brought photos of our wedding day to the AOS interview and the officer took all of them to add to our file. I also submitted dated photos for ROC showing that our families were celebrating us 1.5 years into our marriage still.

In response to Stuart & Thea: I filed for my ROC last year and did not have an interview. That already contradicts the "every single case".
