1.      You were issued a J-1 student visa based on your Iranian financial documents that you provided during the admission and visa process with Georgia Tech.
2.      We DID NOT make a mistake and you are NOT subject based on the skills list. Skills list 212e can only be determined/given by Dept. of State based on the 2009 DOS Skills List….
3.      You are subject because you were funded by your home government.
4.      All determinations of 212e are made final by the Dept of State’s Visa Officers, OIE reviewed your financial documents and determined there were gov’t funds. The Dept. of State made the final determination and agreed with OIE. They then indicated on the form through their signature that you were indeed subject to 212e."

 

If your government funded you and they gave your the No objection letter, then you should be fine. 

 

Anyone who received any type of government funding also has the 2 year home residency requirement. Basically you can get into the requirement due to government funding or skill list.

I am still waiting. USCIS received my case on February 2 and I have heard nothing since then.

We sent the immigration package on May 8th without the approved waiver.
