Hello,

I would greatly appreciate your guidance here.

I am a US citizen and am trying to get my mom into US. Mom and Dad were here on GC in 1999. They left in 2000. Dad passed away. Mom stayed in Pakistan due to medical being too expensive here. Her GC expired in 2010. I would like to bring her here as I believe I can afford her medical insurance now.

The options I see here are:

1) Request USCIS to re-instate her old GC. Will they entertain this request?

2) Apply again for her GC. How long before she is eligible to come here?

you must petition for her again, and on the forms that request A# ( the number on her GC ) and her social security number, you need to put the same numbers she had, those numbers are given once in a lifetime, so she will be given the same numbers

Hey guys if any of you have some info about SB-1 over-stayed visa will be very helpful.. So my Mother in law only came to U.S once then she got her G.C and left for pakistan after two or three years she wanted to come back. So they go through the whole paper work, case was accepted and step by step things were getting done. They requested the medical and DS-260 and other immigration process. today she had interview in Islamabad embassy. He asked her why she didn't go back in 2014 as she was hospitalized for 25 days Bcoz of major heart issues in May 2014 it took a while for her to recover and then my husband and I got married in August so the rest of her kids came to visit her as well and attended the wedding. Also he put her case in administrative processing and kept her passport. Gave her letter that says they're denying her visa but collect ur passport in Karachi visa consulate & the girl at the counter in embassy checked the status as they were exiting said the case is in investigation process and they'll contact back. Please let me know any help will be really appreciated.. Thank you

BeeSee your mother was sick while she stayed out and wanted to come back when she recovered. This woman that the post is for has not been constantly sick for over a decade . It makes a difference in being able to get the SB-1 . RE applying is the correct route in this case

This will not be over quickly. You will not enjoy this.

Has she been filing her taxes? Did she surrender her GC?

Try the SB-1 visa also called the returning resident visa. If i were you, i would personally go with her to the consulate and explain the whole situation. Giving it a shot will not hurt.

I suggest option 2. Figure 11 to 18 months before the immigrant visa foil is attached to the passport and the visa packet arrives in her hands from the IV Unit in Islamabad. Once she has it in her hands, she has up to 6 months for the first transit into the USA.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

She has been gone for 16 years, what is there to explain?

To qualify for the SB-1, you have to document that the GC holder could not return to the US for reasons that were beyond their control (an example: in a car accident and in the hospital and rehabilitation for a year). It would be hard to show there were reasons for 16 years that were beyond her control. Best route is to file a new petition.
