We finished our medical in Sep, received the VIsa's in Dec, will be leaving 9 days before the medical expire date, which I guess it the Visa expire date.

Does this sound too close?

When did most of you leave for POE before your medical expire date for your Visas?

You actually can leave the day it expires (I wouldn't recommend this, but it's theoretically possible). If you board an aircraft on the visa expiry date, it's considered valid no matter how long it takes you to get to the US.

From memory I think it has to be a direct flight. I'll look it up tomorrow if I remember.

That is wrong information. The individual has to be on US soil before the expiration date based on the local time and not the time they left. Also, I would never recommend to leave the day before because if the traveler experiences delays of any sort and then lands after the visa expires then he will be turned away at immigration.

The expiration date of your visa is the last day you may use the visa to enter the United States. It does not indicate how long you may stay in the United States. Your stay is determined by the Department of Homeland Security at your port of entry. As long as you comply with the Department of Homeland Security decision on the conditions of your stay, you should have no problem.

Yes that would be a bit too close for sure, could have travel delays or a cancel which would put you half way with final entry denied.

Thanks

I don't just pull this stuff out of the air, you know.

8 CFR 211.3:

"An immigrant visa, reentry permit, refugee travel document, or a permanent resident card shall be regarded as unexpired if the rightful holder embarked or enplaned before the expiration of his or her immigrant visa, reentry permit, or refugee travel document, or with respect to a permanent resident card, before the first anniversary of the date on which he or she departed from the United States, provided that the vessel or aircraft on which he or she so embarked or enplaned arrives in the United States or foreign contiguous territory on a continuous voyage. The continuity of the voyage shall not be deemed to have been interrupted by scheduled or emergency stops of the vessel or aircraft en route to the United States or foreign contiguous territory, or by a layover in foreign contiguous territory necessitated solely for the purpose of effecting a transportation connection to the United States."

And it is at the sole discretion of the CBP to allow entry.

I will stick with the other's suggestion .... arrive BEFORE expiration of the visa.

And as I posted above, 8 CFR 211.3 considers it as unexpired if you boarded before the immigrant visa expires.
