Hello. My interview was on june 29, 2015 and we were put on AP for further processing. A few days ago my fiance received a call from the embassy informing him to go pick up his passport and instructions. When my fiance got the letter it informed him that the visa was refused under section 212a for being a drug (marijuana) abuser. Please dont judge us as I know that it was very stupid and irresponsible of him to consume knowing the possible consequences of his actions and I beg you not to give me relationship advice as I know and understand you might be tempted to. But I BEG OF YOU to please share some information or personal experiences on the immigrational steps to follow once in this situation. Any and all immigration opinions are welcome, no matter how harsh please be 100% straightforward with me.

I am really sorry I know this is painful. Well hopefully on the form given they told your fiance' that he can com for 2nd interview in a year.

Usually there's steps like having to see a doctor for occasional urine test and seek counseling for the year ban. Than he comes back in a year and all checks out okay you are approved.

So I would email the embassy and ask what are your steps you should take. Stay strong you'll both get through this fine ok.

Timeline

He will have a one year ban. He will have to get drug treatment and periodic drug tests where he must test negative. After that he can reschedule medical.

Depends on what drugs they found. You said Marijuana and if it is just that then usually a year ban is the result.

Is he in a treatment programme?

Did he disclose to the physician at the medical exam that he does use drugs?

My wife told me that they only asked her if she used drugs.

Are you sure that the reason for the denial was based solely on the medical results and not because of something in his police file?

Well, I just learned something new as I did not know they drug test at the medical exam.

I was not tested for drug use, I was asked.

Looking further into the type of refusal either 212a or 212g and I found the below information from the Dept of State website

What does a denial under INA section 212(a)(6)©(i) mean?

You were refused, or found ineligible, for a visa under section 212(a)(6)©(i) because you attempted to receive a visa or enter the United States by willfully misrepresenting a material fact or committing fraud. This is a permanent ineligibility, so every time you apply for a visa, you will be found ineligible for this reason.
