I received notice today that my I-485 has been denied. This came as a complete shock as last year we had a notice that our case may not need an interview. About three weeks ago I had a notice saying that I needed to see a civil surgeon regarding a medical and a footnote to say that there was something on my London medical which needed follow up. I contacted USCIS and someone told me that it wasn't in fact a medical I needed, it was due to the fact that my vaccine record sent by London said that it was incomplete. I duly went along to a civil surgeon and had my MMR vaccine, received my sealed envelope, sent it off and today I received my denial notice. My partner looked at the copy of the medical form which I was given by the civil surgeon and she had just put lines through the medical section and through the section where she should have put her name and address, she had signed the form and so had I. I am at a loss to see why I have been declined, my partner suggests it is because the civil surgeon filled in her section incorrectly, has anyone experienced this? Does anyone have any advice? I am desperate for help

Yes, we were married May 2014

I can only think it would be the completion of the form by the civil surgeon, my medical in London was completed in Jan 2014 and I filed for AOS a couple of weeks after we wer married. Will I have to pay another fee to start the process again ?

Wow, so the CS made a mistake on the form and you got denied ?! How the heck is that supposed to be your fault ?

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Go see your congressman's or senator's immigration aide - they all have them. They have direct line to USCIS and can find out for you exact reason for rejection and what can be done about it. You'll need to sign some release form to get them to check in on your case but they're quick with responses if you stay in touch with them.

I second milimelo's advice. We used our congressman to expedite our EAD and it was amazing. He would keep calling USCIS, USCIS would *always* respond that they can't change anything in their process and I am in line just like everyone else, and then magically things would get updated 1 hour later. This happened over and over! So either the congressman helped or we just had a lot of coincidences.

(Also funny reply to your post using the word "partner"! Of course partner is spouse! Ah America.)

I don't think you have provided enough information for anybody on the forums to help you sort it. You have no timeline and have provided no date information.

When was the medical at Knightsbridge? What dates are listed by your two MMR shots?

When did you mail AOS?

Did you have biometrics?

"About three weeks ago" you received a notice. There is a date on it. Your online status has a date any RFE was issued. What date? It would be very unusual if you were not given about 87 days to respond. What is the date? I am just wanting clarification that in 21 days time, you could receive an RFE, see a civil surgeon, mail a report to USCIS, they review it, prepare a denial, and you get in by mail. All that within three weeks/21 days.

What was the exact wording of the RFE letter? You may have not understood it fully and summarized it to you understanding. are you sure USCIS didn't lose your medical record?

Who is the "someone" who gave you information on the phone? Was it a USCIS officer or the rep who answers the phone? Date?

What was the exact wording of the denial?

I havent received the denial letter as yet, i received an email yesterday, telling me of the denial.

My medical was done in Knightbridge on January 30th 2014, my 2nd MMR shot was done when I went to the civil surgeon on June 22nd, i mailed the AOS during the last week in May 2014, I have exact details at home.I received the inital RFE a week before my appointment with the civil surgeon on June 22nd, I mailed the report the following day and yesterday I received the denial email

I have only had biometrics for my employment authorisation and advanced parole which was renewed until June 26th 2016. The person at the UCIS was an officer I believe, she told mt that it wasnt a medical I needed just the vaccine update as it stated incomplete on the form given to me at Knightsbridge, again I have the exact date of that phone call at h ome, i made the call the same day as i received the notice for clarification.In September 2014 i received a letter stating that my case was a potential Waiver of Interview.

There are people being asked to have a new full medical exam after so long. Yours is 18 months old. Maybe you can add the exact wording of the RFE when you get home.

Was one of the three incomplete boxes ticked?

What was the date of first MMR marked on the DS-3025?

To me it sounds like you were not complete on MMR, so you needed a civil surgeon from the get go prior to submitting AOS. But you didn't do that. So by the time you are doing that in June 2015, your entire previous medical exam is being thrown out in favor of a new one because 18 months have elapsed.

Now maybe had you not done your needed MMR and they got to your case in just four months, they would have accepted a shot only update. But they took so long and are probably considering the medical as no longer valid. That is my guess. You did not provide a medical so they can't approve.

Maybe an infopass appointment with a live person could help sort this. I doubt a legislative aide knows enough nitty gritty of I-693 rules and exceptions to get to the root of the problem by asking the right questions.

The knightsbridge doctor did state that my vaccine was incomplete, that is why they needed me to go to the civil surgeon to get my MMR. According the the USCIS website I shouldnt need a new medical if I applied for AOS within 12 months of having my initial medical, mine was within 5 months. I didnt need a civil surgeon at the start, i just went along to the london medical as instructed.

But you mentioned there was something to "be followed up with" in your medical and perhaps you do need to see a CS for that.
