first at all im not sure if iam posting in the right place

anyways my story here

iam from lebanon i moved to us california san francisco on a green card cr1 visa

i lived with my wife arround 11 months - during this period time wr had so much problem , ex: she wont let me b with her or touch her bla bla bla .....

so i came back to my country and my gc expired , since i came back we naver talked or anything its been over 2 years no communication . i heard last week that she got married to a lebanese citizen and he is already there ,, is that possible since she didnt sent me any divorced pappers or anything else , while i registred my marriage here in lebanon before i tooked my immigration visa

She could have served you via public notice. But she would have had to try to reach you at your last known address via registered mail first. Sounds like she is still married to you. Report it if you wish.

If the new hubby needed to immigrate she had to show papers for termination of prior marriages. But if you suspect something you can check online for divorces , they are public record. If you find nothing then USCIS and the local police, bigamy is a crime in every state but rarely prosecuted. My ex got citizenship in the US despite being married to more than 1 wife for almost all of his years as an LPR

This will not be over quickly. You will not enjoy this.

1) In US, marriage/divorce records are publicand they are kept at the county office.

So you need to find the county office of where your ex-wife could have filed for the divorce.

If you believe she still lived in San Franciso area when she filed for divorce,

then you can go to this county web site to request a copy of the final divorce decree.

If that's not the place, then simply google the city name with the "county office" in your search.

2) Some counties (like where I live) allow you to search (and view) for public records like marriage license

and divorce records. But San Franciso seems to only take mail-in request. I can't seem to find the

online search page for it.

3) That said, if you came to US on CR-1 visa and you never reported your marriage to the county,

then potentially (at the county level) there is no record of your marriage, and I can see how

she could have been able to acquire the marriage license and get married.

Regardless of the county records, USCIS should know about the marriage because CR-1 was filed,

so if she were to go through another spouse visa, unless she provides

final divorce decree, she wouldn't be able to get through the processing.

However, if he was already in US, presumably legally, then with no marriage record at the court,

I can see how she would have been able to marry someone else.

4) It sounds like your relationship was pretty much over...though you guys didn't jointly go through

the divorce processing. Were you thinking to save your marriage some point?

If you had no interest in continuing the marriage with her, then just let this be.

5) However, you probably should clean up marriage record in your home country,

so you need to look into filing a divorce from your home country...if you think she didn't

go through the divorce processing already in US.

6) Therefore, if she filed for divorce and it got processed because you couldn't be located.

then, you should be able to get the final divorce decree, and use that to

clean up your marriage status in your home country.

If she didn't file for divorce, then you probably want to start one from Lebanon.

As for reporting this to authority, unless that's required to clean up your marriage record

in Lebanon, I wouldn't bother with it. You guys were essentially (emotionally) divorced already

when you two didn't even talk for 2 years. So just let her move on with new marriage.

She divorced you....all she had to do not knowing your whereabouts is

satisfying the court with newspaper notice, you had no property or kids

together and she moved on.

OP bigamy is hardly a charge sentenced these days , unless U being vindictive,

but even without her being married you abandon GC, so divorce in your country

if U have to, and move on

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

My opinion is, if she made no ""effort"" to notify you, then, technically, you are still married..,at least legally.

I would follow this trail.
