Is she Cuban? If she is.. can't she do it on her own due to the US laws for Cubans? I'm just throwing out ideas, I have no clue if that would apply when married.

That's why I suggested he be reasoned with.

In fact, his fear that she might leave him if she had a greencard could not be more unfounded. If indeed, all she wanted was a greencard she would be better off getting a divorce and marrying another USC.

I think this is one of those instances where someone needs to have a good talk with the husband and allay his fears.

lol... the illegals protesting outside the white house are not arrested for being illegals in this country.

Criminal illegals are released back to the communities instead of getting deported.

If he is keeping her against her will, then that would be another charge. However, as long as the front door is not locked from the outside, she can come and go as she pleases, and he is not breaking any laws. Thank you for visiting the US.

she can leave any time she wants. I am sure nobody is holding her here. The OP just said he won't file the papers because he is afraid she will leave. She is staying on her own. Nobody can force him to file papers . If she doesn't like it. she can leave and find another person to marry and get papers.. There needs to be an I-130 before the I-485 gets filed anyway

My aunt married a U.S Citizen 25 years ago. He did not want to help her fix her status because he said she was going to leave him. All these years he has threaten her to call immigration on her when he gets mad. Does anyone know if there is a form that applys to your husband not fixing your status so I can help apply for in this case?

I'm unclear on what status she is in...what do you mean fix her status?

Is she still in Cuba?

Is she in US illegally?

Bottom line is, this is way too complex an issue for the OP to navigate on her own, or with only VJ advice. A good immigration lawyer is definitely needed.

Self-Petition. I-360. 25 years together is a bono fide marriage. Where is the abuse? Does not filing an I-130 on her behalf constitute abuse? Does threatening to call the INS on her every time she threatens to leave him do the trick, after all this time? Don't know.

thanks for correcting my misthinking .but that was my opinion .and i am not trying to cover myself either .i have friend whose husband dont want to fix her status .i feel sorry for people who are in those situation ,that is all . To deal with immagration ,it is wise to ask a lawyer to get professional advice and seek any possible solution instead of just being threatend and misreable .that is just a commen sense .

I know that when you are a victim of domestic violence or abuse you can obtain residence under some protecting status. If he is threatening her and refuses to marry her, perhaps she qualifies under domestic abuse.
