OP, you have give us very little to answer, as we have no reason, specific reason for ""WHY"" your evidence was lacking!

Me Myself&1's post, just because you get an attorney, the OP needs to give the evidence.

I hope the OP can get his 221g, and fulfill it's obligations, and things go well for him, but an immigration attorney is not the answer. This is just one opinion, maybe its right, maybe not.

Now that they have denied our petition and sending it back to the states can me and my fiancé apply for a spouse Visa as soon as possible. Because the CO said we should try a spouse Visa.

Send a notarized letter to USCIS, NVC and the Embassy formally withdrawing the petition.

Sounds like the Embassy CO told you how to proceed.

You have not stated your reason for denial.

You have not answered anyone's questions.

And it is highly unlikely or very strange that the CO who denied you based on lack of evidence suggest you try the CR1 visa.

This all seems very suspicious.

Before you do anything you need to find out why you were denied. Getting married won't solve anything if they think you don't have a bonafide relationship.

There's obviously something else going on here that the OP is omitting. I'd be content if (s)he would just come on here & say "Thanks for everyone's attempt to help. For personal reasons, I can't answer any of your questions. Again, thanks for your help."

If they recommended the CR-1 visa does that not imply that you are already married? Or at least that they believe so? I can't see why they'd recommend it if they didn't believe the relationship was genuine.

Some Embassies are easier on married couples than the unmarried ones. Probably because the marriage process in the foreign country vets out the legitimacy of any visa fraud intent.

So that means we cannot reapply unless they send this petition back to the NVS. But what a waste of time and money. This process take long and it's hard not be with your love. The CO must know how it feels like. I don't know if something can be still done for the embassy to contact me back . Maybe it's because the first CO who interviewed me on Jan 06 2015 was not the same person who interviewed me on Febuary 17 2015. Because I had all evidence and a the questions she asked I answered.. Someone should help me with good answers. If a lawyer can contact the embassy so they can do something.

A lawyer has no power over the opinion of the CO you talked with. They can present a more professional , less emotion driven petition and can point out exact laws that pertain to your filing if you are running afowl of some legal issue. Many couple build a petition on emotions rather than present evidene and forget that the CO doesn't know you and you must fill in the picture of your relationship to show that indeed you have a relationship. A few photos, passport stamps and pages of communication does not prove a relationship and that is all many people throw into their petition. K1's sent back are almost always declared expired as it has been more than 4 months since the original approval. Sit down and decide if you want to go another K1 ( better presented ) or get married and file a CR1. Getting denied is a royal pain the the rear but it isn't the end of the world.

This will not be over quickly. You will not enjoy this.

Thank you so much. So that means we cannot do anything about this petition. And we cannot reapply unless the petition get back to the NVS or we can still reapply. Because maybe they have that one in thier system.

It's sad that the embassy treat people this way. So it means they cannot reaffirm it unless we start a new process even though our petition says administrative process once I check our case. But the CO send it will be sent back to the NVS. I was hoping they can call me because the first time I went the CO asked me why I did not print my facebook messages direct from FB. She kept our conversation and told me to bring more evidence. I took screen shot of our facebook chats for the second interview and met a different CO so I don't know what went wrong again.

I took every evidence today but the CO is telling me she is sending our case back and she annoy approve our petition. It's sad that you will waste Money on medicals,appointment fees and time but they will not grant you a visa. I want to know if a lawyer can help me still gain this visa back without startng the process again.

From what I am told and seen on here...there has only been 2 or 3 K-1 visa approved in Ghana in 2014. All the cases seem to be just like yours. Told to come back then they are denied! Our case is in the process of being sent to Ghana and I am just so concerned. I will be at the interview with my fiancé but right now it really scares me because of the outcome of the K-1 visa.

Most couples once denied on the second interview get married and file the I-130.

We have Skype chats and screen caps, Whatsapp, and yahoo chats. Tons of phone logs, receipts phone bills, insurance policies together, bank account, credit card. I have our wedding invitations, cards, DHL receipts, and much more. I have so much evidence I hope it all works out good for us.
