There is AP: Wait until a decision is made, days, weeks or even years.

There is plain Denial: Start from square one with a better prepared case.

There is Denial with 3-10 years period of inadmissibility: Successfully apply for a waiver or wait out the said period.

There is Denial with permanent inadmissibility: Must successfully apply for a waiver (if eligible) to restart on the VJ path.

I have come across cases where CO's had the authority to place inadmissibility decisions for non-immigrant visas. I'll be surprised if they have the same authority regarding immigrant visas, especially those involving USC relatives.

At this point, I suggest we give our dear friend some time and space to get the facts straight and within the proper context, regarding the interview outcome. Hopefully, there will emerge a clear path to take, moving forward, toward a successful conclusion.

On a separate note, it is really disgusting how USC spouses are subjected to this gruesome process when others are not. For example, I was on an employment-based category. And while I was grilled over my own academic credentials, no second thought was given to my wife and she was awarded the immigrant visa with only the marriage certficate as evidence!!!

After reading some previous 212 denials in VJ it seems like Solenta will have to start over. :(

Soloenta I'm so sorry. I'm in shock watching you post for good new all morning, this isn't what I expected to hear. Don't give up where there is a will there is a way.

I'm not sure my friend, immigration can do what they wish and we are in their hands. I'm sorry I'm late in responding but I've been sleeping non stop and only get up when I hear it's my husband, I have a cell just for him, no one else. Then I get on Skype then I sleep again. Thank you for your kind words.

Solenta, I don't have the words to express how unjust this process has been for you. I will pray that God will intervene and make this right. I pray God will comfort you and your hubby in your time of need and that He will bring you all out of this more than conquerers. Please know God always has the final say and the enemy will not win this battle.

I'm so very happy to see you, it's been a while and thank you so much for such beautiful heart felt words. I hope God listens to your prayers we need a miracle right now and they are so hard to come by. This will not be an easy battle and like others getting this section 212 it's really not clear what this man took exception to. He was trying to trip my husband up left and right trying to confuse him but he wasn't rude to him. Embassy in Cairo is notorious for being very rude. My husband did make two mistakes and with no sleep and being nervous well I don't blame him. There should be an automatic second interview not everyone is an expert at this. I agree, God does always have the final say! Thank you.

Soloenta, it's been a while since I've been here. :( I'm so sorry to hear about what happened. I read your post above and the only other things I can think of for proof of relationship are notarized sworn affidavits from your family and friends and his family and friends, and emails or chats where other people mention your husband, if you have them.

Thank you my friend the Co didn't even ask for more evidence only one picture he had of us the day before of the day of our wedding. But thank you I'll check my e-mails. :(

Why would you send in one picture? It seems like you gave your SO until the last minute to download chatlogs and other sorts of things also. This isn't a game Solenta. Are you sure you are in AP? When you eventually get to the greencard phase/removal of conditions (I believe you are in AP and things will resolve themselves) don't play around and send in little material evidence. Send in AS MUCH as possible. Good luck.

I know this isn't a game and have sent everything we have, chat logs, texts, cards etc, chat logs with my parents when I was living in Egypt for almost two years. The picture your talking about was lost at the place we had it taken I asked my husband to check back with the receipt and by the grace of God they found it. No we are not in AP if you read section 212 a 6 c1 . I've been in this way to long to think this is a game. We have tons of chat logs it was just the last two months we didn't get a chance to get copies of.

not having enough bon e fide evidence for marriage would make you a misrep, not enough evidence is a representation of willfully misreping oneself? im confused by the wording that's all? if everyone that didn't have enough evidence to show they are married and this is what's given then I totally get it and that's how it is for everyone. just trying to figure this all out from what was written

No our status says AP and yes it is confusing. I see explanations I'm sure below.

It is such BS that you have to wait 1.5 years to be rejected in the span of 5 minutes. If the CO feels like the relationship is bogus how about rejecting the petition within 3 months instead of making someone go through the anguish of being denied 1 foot away from the finish line. I never want to hear that ####### that the consular officers are "intelligent" and that they can "spot" fraud. they are a bunch of incompetent, low-life idiots

It is such BS that you have to wait 1.5 years to be rejected in the span of 5 minutes. If the CO feels like the relationship is bogus how about rejecting the petition within 3 months instead of making someone go through the anguish of being denied 1 foot away from the finish line. I never want to hear that ####### that the consular officers are "intelligent" and that they can "spot" fraud. they are a bunch of incompetent, low-life idiots

Thank you very much and I can a sure you we are the real thing and frauds know all the tricks, tons of pictures. We really had no idea of all the chats etc or we would have had them since day one. I called both Virgin Mobile and T-Mobile for text logs and they said they couldn't send them to me I'm guessing because I pay as I go cheaper and makes much more sense. If I had known I would have purchased an over priced plan of which I would have only used text since we use Skype to talk and so far Skype only saves six months worth. Anyway thank you so much and we are the real thing, neither one of us would have done this for all the money in the world it's just not worth it.

I'm so sorry I can't thank you individually right now, this is what my husband received after the interview.

What does a denial under INA section 212(a)(6)©(i) mean?

You were refused, or found ineligible, for a visa under section 212(a)(6)©(i) because you attempted to receive a visa or enter the United States by willfully misrepresenting a material fact or committing fraud. This is a permanent ineligibility, so every time you apply for a visa, you will be found ineligible for this reason.

You will be advised by the consular officer if you can apply for a waiver of this ineligibility. Review Waivers of Ineligibility for more information.

What is meant by misrepresentation of a material fact?

Misrepresentation means that you falsely presented facts and were not truthful in an attempt to receive a visa or enter the United States. A fact is considered material, as it pertains to this section of the INA, when, had the truth been known, you would not have been eligible to receive a visa or enter the United States.

He said we need more proof of Bona Fide marriage, I don't know what else we can give them. I am beyond devastated and just want to sleep for the rest of my life. They are sending us back to NVC. My worst nightmare has come true we are in AP. God bless you all for your prayers and kind words.

Solenta I am so sorry that you now are also going thru this. they must do this to those who they think are weak and are going to give in and give up. but if your anything like me I know that your going to fight to be with your husband. I am fighting as we speak to be with my husband. am taking some time off of work in fact all of my vacation time and I am taking a trip to Ghana to be with him for 19 days. I can't wait to see him. its been a long time. too long of a time with out being with him. I know how you are feeling and the emotions that you are going thru as I go thru them myself daily in this horror we call AP or in my case recommendation for revocation. I wish you the best and keep you and your husband in my prayers. I am sorry I didn't post before this but I am just so heart broken for you I was praying that this would not happen to you with all the other things that have happened during this horrible process to be with our loved ones. please remember we are all here praying for you and are here if you need shoulders.
