VISA approved, now what? Work?

Hi guys, I've had my k1 visa delivered to me and I'm due to leave the uk at the end of February. I was wondering how do I obtain a social security number and will I be able to work? If not how can I be able to do so? Thanks in advance!

Your visa gets you into the US for 90 days so you can marry. If you want to work or drive or become a permanent resident then you must do adjustment of status. $1070 and lots of paperwork. Click on the word Guides in the menu bar and find adjustment of status topics relating to a K1. If you are trying to do this on a smart phone, you are likely going to miss out on important information. Get on a PC for best results.

There is also a topic on how to get your SSN, which by itself does not give you authorization to work. But you can get a number as a K1 shortly after arrival on your visa. It will be useful for getting a bank account.

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

Come to US.

Then, get marry.

Then, file for AOS based on marriage to a USC in order to get a green card. At same time, request Employment Authirization Document (EAD) With the AOS. Apply for SSN at the local SSA office.

The green card will take 6+ months. The EAD will take about 90 days. The SSN will take about a month.

With both the SSN and EAD, you can legally work.

There will be at least 3 months where you can not work. Be prepared for this free time.

How long was your visa issued? I passed interview last Jan/14 but my visa was not issued.....So worry.

2014/04/19: Sent I-129F Packet.

2014/04/21: USCIS received

2014/04/23: NOA1 received

2014/10/15 : got approval (NOA2)

2014/11/12: got case number through phone to NVC

2014/11/18 : case ready in VN.

2014/11/20: submit DS 160.

2014/11/21 : pay for visa fee.

2014/11/21: account active for booking.

2015/01/14 : INTERVIEW - APPROVED

Pretty much what most of the other posters said. Also if you get a Notification of Potential Interview Waiver (NPIW) be prepared to wait another 6+ months from that letter. I applied in July, got NPIW in November, and from other people's timelines it seems they approve in about 6 months from there without a interview. Some people have still gotten interview.

Make sure you apple for EAD and AP. Do not leave the USA without AP, or you application is abandoned.

Our wedding is on the 16th may and my visa expires on the 24th may so we'll be submitting the AOS immediately after the wedding. When is the best time for me to apply for the ead?? I know to wait 10 days after my arrival before I apply for SSN so that's covered. Just wondered like I said when is the best time to apply for the EAD? Thank you guys

Your visa expiration date has nothing to do with your AOS. It is the date by which you must enter the US. Once you use the visa, it is null and void. Your only requirement is to marry within 90 days. You have no deadline date for applying for AOS, but the sooner you do, the quicker you work and such. If you enter in February and don't send off AOS until end of May, then you are going to have six months where you do nothing.

You file for AOS/EAD/AP altogether after marriage. Then wait 3 months beyond that to get work approval (and even longer to get the greencard).

Correct. We went to local SSA office to get my then fiancee's SS Card 2 days after she arrived. The only reason not sooner was because her POE was Dec 31 at 545 PM & they were closed & the next day was a Holiday.

I just arrived a couple of months ago and have just gone through all of this.

You can get your SNN as soon as 10ish days. If your changing your name after the wedding its really easy to do after, just a basic form.

You have to apply for AOS/EAD/AP all together after the wedding once you have marriage license, etc. Its aprox 90 days after biometric that your EAD will be approved, for me, that added another month on top of the wait.

TIP: As soon as you get here start getting stuff in both your names and piggy back off your husband/wifes credit cards to try to get credit and evidence for AOS.

I have AMAZING credit in Aus but i can't even get a bloody phone plan here.

Since you're entering end of February, to speed up the process, you could marry at the court house/city hall and that will get you the marriage certificate before may, otherwise if you only file for AOS in May, you will have to wait until about August to get your EAD. You can only apply for EAD and AOS after you have the marriage certificate in hands.

The 10 day suggestion comes from when I-94s were cards filled out on the plane and turned in at POE. The cards had to be manually typed in and uploaded to a USCIS database before SSA could verify legal entry details using the SAVE database. The manual delay was eliminated when I-94 went paperless and the information on the entry was populated from electronically scanning the passport. You are correct that in theory the verification should be available immediately now because of the technology update to the process.

So get there, apply for SSN then marry her and file for AOS,EAD and AP? And can I just go to the social security office and apply there and then or is there a form I need to download then take with me? I can't see the full website because of my phone :( I don't have a laptop either ugh. We'll be going to the SSN office within the first two days of me being there. We're both so excited! I can't wait to marry her. Thanks guys
