VISA approved, now what? Work?

So get there, apply for SSN then marry her and file for AOS,EAD and AP? And can I just go to the social security office and apply there and then or is there a form I need to download then take with me? I can't see the full website because of my phone :( I don't have a laptop either ugh. We'll be going to the SSN office within the first two days of me being there. We're both so excited! I can't wait to marry her. Thanks guys

I arrived here in CA on December 26, 2014. Then we get our marriage license and get married at the same time (December 30th) - civil wed) at Oakland County Recorder. I applied for my SSN on January 15th with my married name and today I got my SS Card... But the card has a note of "valid for work only with DHS Authorization". Since there's no deadline for applying AOS, we decided to apply for EAD first so I could work then save money for my AOS.

Applying for EAD without filing for AOS will only get you an EAD that is valid for 90 days and cannot be renewed. Waste of money. So you will wait for 3 months, and then only be able to work for 3 months, although, fair enough you can earn the needed amount in 3 months, but then you have to stop working and apply for the new EAD.

Your plan is flawed.

In order for the EAD to be effective there has to be an underlying immigration status that allows you to have the EAD.

Without the AOS, your immigration status is the K-1. That status ends 90 days after you enter. So the EAD is effective as long as you are in status. Once the 90 days are over, the EAD is no longer good. In addition, it takes about 90 days to get the EAD, so you will get maybe a few weeks of work authorization at best. Even with the EAD, you would be working illegally after 90 days because you will be out of status and a visa overstay for not filing for an AOS.

By filing the EAD with the AOS, the underlying AOS status means the EAD is valid until the green card comes.

Your plan will not get you the results you want.

She cannot apply for your SSN before your arrival because you need your I 94 to apply for SSN. It is electronic now but you cannot obtain that prior to entry. People have said that you can apply for SSN as soon as the day after you complete procedures at POE because it is now updated electronically.

Have you still not read the excellent guide on how to get a SSN?

It requires your passport with visa. Does your fiancé have that?

It requires proof you entered the US on a K1visa (form I-94). Does your fiancé have that?

Read and think about it and apply some logic. If you need personal spoon feeding, then that's why people hire lawyers. To do-it-yourself requires reading information people point out to you.

If you need to save money to pay for AOS, then why in the world would you want to waste $380 on an EAD that will expire when your I-94 does? Once it expires, you can no longer work, so if it takes 60-90 days to receive an EAD, you will have no time to actually work using an EAD with the (a )(6 ) category based on your K-1 stay. It is not renewable.

Would be so much better to save that $380 and apply it towards the $1070 AOS fee. When you apply for the EAD with a pending I-485, then there is no fee for the EAD. It will be based on your AOS application, category (c )(9 ), and will be valid for a year and is renewable if your green card has not been approved by then.

You couldn't possibly know what your I-94 says as you don't have it until you enter the US. This is probably what your visa says, which means you must enter the USA by March 25th. Once you enter USA you have 90 days to marry, but as you mentioned before you want to be married before the 90 days so you apply for AOS sooner. There is no deadline to file AOS but the sooner you do, the sooner you will have your EAD be able to help your spouse :)

You couldn't possibly know what your I-94 says as you don't have it until you enter the US. This is probably what your visa says, which means you must enter the USA by March 25th. Once you enter USA you have 90 days to marry, but as you mentioned before you want to be married before the 90 days so you apply for AOS sooner. There is no deadline to file AOS but the sooner you do, the sooner you will have your EAD be able to help your spouse :)
